Nunes Marques Signals Post-Election Review of Bolsonaro Sentence Suspension Request

Supreme Federal Court Justice Kassio Nunes Marques has indicated to associates that he will examine former President Jair Bolsonaro’s request to suspend the execution of his prison sentence only after Brazil’s presidential runoff concludes on October 25, 2026. The timing, reported by Folha de S.Paulo and confirmed by CNN Brasil on October 5, aims to prevent any perception that a judicial decision could influence the contest between Luiz Inácio Lula da Silva and Flávio Bolsonaro.
Bolsonaro was sentenced on September 11, 2025, by the STF’s First Panel to 27 years and three months for organization of an armed criminal group, attempted coup d’état, attempted violent abolition of the democratic rule of law, qualified damage, and deterioration of protected heritage. The vote was 4-1, with Justice Luiz Fux dissenting in favor of acquittal. Since March 2026 he has served the term under house arrest ordered by Justice Alexandre de Moraes after treatment for aspirative bronchopneumonia.
His defense filed a criminal review petition in May 2026, assigned to Nunes Marques, who was appointed to the court by Bolsonaro and currently presides over the Superior Electoral Court. The filing argues that the First Panel lacked competence under the STF’s internal rules for matters involving a sitting president, that the defense received insufficient time and incomplete access to digital evidence, and that breaks occurred in the chain of custody of materials taken from Bolsonaro’s phone. A subsequent request filed in late September seeks provisional suspension of the sentence so that Bolsonaro is not held while the review proceeds. The Prosecutor General’s Office, under Paulo Gonet, recommended in June that the court decline to examine the petition on the merits.
According to accounts given to Folha and CNN, Nunes Marques has told aides he sees procedural excesses in the original case and is weighing whether a preliminary injunction could release Bolsonaro, though the more probable path is referral of the full review to the STF plenary once the election period ends. He has given no public indication of the outcome. Earlier reports in early October noted that any decision was expected to wait until after the vote to avoid disrupting the electoral calendar.
The sequence leaves open the possibility that a justice appointed by the defendant will place before the full court arguments about panel jurisdiction and evidence handling that the original 4-1 panel did not accept. No ruling has been issued, and the house-arrest order remains in force.
