I have been following with concern the news from Brazil, especially the report of lawyers and journalists, Americans and Brazilians, about what has been happening. In the name of the freedoms enshrined in both the Brazilian Constitution and in the American democratic tradition, and in consideration of Brazil’s role as a global actor in the political and economic scenario, I ask you to clarify and formalize the official position of the Brazilian Bar Association, its Directors and Advisors, and the effective measures adopted to combat the illegalities widely reported in the Brazilian and international press.

Senator Shane David Jett, from the State of Oklahoma, sent a letter to the Federal Council of the Brazilian Bar Association (OAB) questioning the entity’s performance in the face of allegations of violations of fundamental rights in the country. The information was released by the American parliamentarian on Thursday (30).

The document was addressed to the president of the OAB, Beto Simonetti, as well as to other directors and federal councilors.

“I have followed with concern the news from Brazil, especially the report of lawyers and journalists, Americans and Brazilians, about what has been happening. In the name of the freedoms enshrined both in the Brazilian Constitution and in the American democratic tradition, and in consideration of Brazil’s role as a global actor in the political and economic scenario, I ask you to clarify and formalize the official position of the Brazilian Bar Association, its Directors and Advisors, and the effective measures adopted to combat the illegalities widely reported in the Brazilian and international press,” said the Republican on the X network.

In the correspondence, the senator highlights the historical role of advocacy in the defense of the Constitution and the Democratic Rule of Law, mentioning the importance of the OAB in the process of redemocratization of Brazil. He highlights that the Federal Constitution ensures the inviolability of the lawyer in the exercise of the profession (art. 133) and that Law No. 8,906/94 assigns to the OAB the mission of defending the legal order, human rights and the prerogatives of advocacy.

Jett expresses concern about frequent complaints in the Brazilian and international press about violations of fundamental rights, such as restrictions on freedom of expression, censorship and persecution of parliamentarians, journalists and lawyers. The senator also mentions reports sent to the Inter-American Commission on Human Rights (IACHR) and questions a possible omission of the OAB in the face of these accusations.

The document warns of the risk of international sanctions against Brazil, citing the US bill “No Censors on our Shores Act”, which proposes measures against authorities involved in violations of freedom of expression.

Finally, the senator requests that the OAB officially clarify its position and detail what measures have been taken to combat these alleged irregularities. He reinforces the need for the institution to reaffirm its commitment to the defense of fundamental freedoms and democratic principles.
