Stephen Miller Calls Flávio Dino’s Performance “Ridiculous, Pathetic and Embarrassing”

American conservative voice Stephen Miller on Monday delivered a blunt assessment of Brazilian Supreme Court Justice Flávio Dino, saying his recent conduct makes it “impossible to consider Brazil a serious country.”
Miller posted that American media had slammed Dino’s performance as “ridiculous, pathetic, and embarrassing.” The remark landed as Dino again inserted himself into Brazil’s election fight.
On Sunday, Dino overturned a Tribunal Superior Eleitoral order from Justice André Mendonça that had required the removal of posts falsely claiming presidential candidate Flávio Bolsonaro planned to strip Nossa Senhora Aparecida of her title as patron saint of Brazil. Dino restored the content and criticized the prior restriction as incompatible with free expression.
Opposition leaders immediately accused the justice of overreach. Senator Rogério Marinho, coordinating Flávio Bolsonaro’s campaign, said Dino was creating “jurisprudence of convenience” to favor President Luiz Inácio Lula da Silva’s side. The campaign’s legal team called the move a usurpation of the electoral court’s constitutional role.
The clash fits a pattern. Dino, a former Justice Minister appointed to the STF by Lula, has drawn repeated fire for mixing political messaging with judicial power. Brazilian commentators have criticized his interventions in high-profile sessions this month, including one in mid-September that opponents described as theatrical and poorly grounded.
Miller’s post frames the episode as more than a local legal dispute. For America First observers, it is another example of a politicized high court undermining institutional credibility. When a justice appears to pick and choose which speech rules apply depending on who benefits, the damage extends beyond one ruling.
Dino and his supporters argue he is defending expression against prior censorship. Critics counter that the same court has spent years restricting opposition speech under the banner of fighting “fake news.” The sudden conversion on this particular set of posts, they say, looks less like principle and more like timing.
The episode arrives in the middle of Brazil’s 2026 presidential campaign. Flávio Bolsonaro has made judicial overreach a central theme. Dino’s latest decision hands that argument fresh material.
Miller’s language was unsparing. Whether or not every American outlet used those exact words, the sentiment he amplified is now circulating: a justice whose performance looks more political than judicial leaves Brazil looking less serious on the world stage.
