TSE Admits Electoral Probe Against Lula Over Publicly Funded Carnival Parade

The Superior Electoral Court (TSE) has admitted an electoral investigation against President Luiz Inácio Lula da Silva and Vice President Geraldo Alckmin over a Carnival 2026 samba school parade that honored Lula’s life and political career. The decision, issued on September 18 by Electoral Inspector-General Minister Antonio Carlos Ferreira, allows the case to proceed but does not constitute a ruling on the merits.
The parade in question took place on February 15, 2026, when Acadêmicos de Niterói opened the Grupo Especial at the Marquês de Sapucaí in Rio de Janeiro. The school, making its debut in the top division, presented the enredo “Do Alto do Mulungu Surge a Esperança: Lula, o Operário do Brasil.” The storyline traced Lula’s path from childhood in Garanhuns, Pernambuco, through the family’s migration to São Paulo, his years as a metalworker and union leader, the founding of the Workers’ Party, two presidential terms, imprisonment, and return to office. Lula watched from a box and did not parade; First Lady Rosângela “Janja” da Silva also stayed off the avenue. The school finished last and was relegated.
Opposition parties argue the spectacle functioned as early electoral promotion. They point to public funding totaling approximately R$9.65 million: R$4 million from the Niterói city government, R$2.5 million from the Rio de Janeiro state government (part of a broader contract with Liesa), R$2.15 million from Riotur (Rio city tourism agency), and R$1 million from Embratur. The federal agency’s contribution was the same amount given to every school in the Grupo Especial under a cooperation agreement. The Federal Court of Accounts (TCU) earlier declined to block the Embratur transfer, finding the distribution followed an equal, objective criterion.
Two separate Ações de Investigação Judicial Eleitoral (AIJE) were filed. The first, submitted by Partido Novo in August, received admissibility in mid-August (case 0601427-66.2026.6.00.0000). The second, filed by presidential candidate Flávio Bolsonaro of the Liberal Party in early September, was admitted on September 18. Both allege abuse of economic and political power plus improper use of the means of communication, citing the national television broadcast of the parade outside the official campaign period. If the TSE later finds the conduct grave enough to have affected the electoral process, possible sanctions include cancellation of the Lula-Alckmin ticket’s registration and an eight-year ban on holding office, under Complementary Law 64/1990.
Lula and Alckmin now have five days after official notification to submit their defenses. Only after that stage will the court decide on evidence production. Earlier attempts to stop the parade itself were rejected by the TSE in February, with ministers stating that alleged abuse could be examined only after the event occurred.
The case remains at the preliminary investigation stage. No finding of guilt has been issued, and the school’s artistic choices and the isonomic nature of some funding streams will form part of the defense. The timing, however, places the dispute squarely inside the 2026 presidential campaign.
