STF Checks Politicized Police Leadership as Director Faces Possible Dismissal

Supreme Court Justice André Mendonça’s decision to remove Andrei Rodrigues from command of the Federal Police marks a rare institutional pushback against alleged overreach inside Brazil’s top investigative body. The preventive suspension, issued Tuesday, also pulled intelligence director Leandro Almada and ordered the PF’s own internal affairs unit to open criminal and disciplinary probes.
Mendonça cited more than 30 days of what he called systematic and illicit monitoring of himself and Attorney General Jorge Messias through secret intelligence reports later shared with Justice Alexandre de Moraes. A majority on the Second Chamber—Mendonça, Luiz Fux and Kassio Nunes Marques—has already signaled support for keeping the removal in place. Rodrigues continues to receive his salary during the initial 90-day window allowed under PF disciplinary rules.
By law, the President of the Republic appoints and can dismiss the Federal Police director-general. Lei 9.266/1996 makes the post a presidential nomination reserved for a career delegate of the special class. That is the power Lula’s government now claims Mendonça invaded. Courts, however, retain the narrower authority to issue a temporary, case-specific suspension when there is a concrete risk the official will interfere with an investigation. Mendonça used that precautionary power, not a permanent firing. The government, through the AGU, is preparing to challenge the order on competence grounds.
Can this lead to him being fired? Yes. Two paths exist. First, the Corregedoria investigations can produce an administrative disciplinary process that ends in dismissal if misconduct is proven. Second, the director-general post remains a presidential appointment. Lula can still remove Rodrigues at any moment, just as he appointed him in January 2023. Partido Novo had even asked for preventive detention; that request was not granted, but the door to permanent removal remains open once the facts are established.
The episode exposes a deeper problem: the Federal Police cannot function as both an independent investigative force and a political instrument. When intelligence reports on sitting Supreme Court justices circulate inside another justice’s inquiry, public confidence in both institutions erodes. Accountability here is not optional. Either the investigations confirm the monitoring was lawful and properly bounded, or they confirm that senior PF leadership crossed a line that no democracy can tolerate.
