The Vault Cracks: Fux Orders the Full Opening of the Pandora’s Box

On Thursday Fux ordered complete electronic access for his chambers to four investigations conducted by Justice Alexandre de Moraes: Inquiry 4.781 (fake news), Inquiry 4.874 (digital militias), and Petitions 10.405 and 12.100. The last of those petitions opened the Tempus Veritatis operation that produced the convictions in the coup-plot case. Volumes, appendices, media, decisions and every piece held under any degree of secrecy are included. The order does not pass through Moraes. It goes straight to the secretariat.

The decision sits inside ADPF 1.144, the action brought by the Progressistas against Moraes’s December 2023 dispatch. That dispatch turned a Federal Police representation into a separate, sealed proceeding and kept the rapporteurship by prevention, without a draw. Fux has not yet ruled on the injunction or the merits. He has ruled that the partial copies already in the file are not enough for a safe judgment, and that secrecy shields an investigation from outsiders, not from the justice charged with testing the constitutionality of the act itself.

The language is the crack in the vault. The case files, Fux wrote, belong to the Tribunal, not to the minister who reports them. To deny the reviewing justice access would be to subtract the Court’s own processes from concentrated constitutional review. “The version of the act, however faithful, does not replace the act.” Equality of arms, he added, begins with equality of access to the facts.

That is why the order landed with the force it did. CNN Brasil, Veja and Metrópoles all recorded the same downstream possibility: a later ruling favorable to the action could reach the validity of the investigations that produced the convictions of Jair Bolsonaro and others. Nothing has been annulled. No sentence has been wiped clean. What has changed is that the sealed record is no longer available only to the office that built it.

For years the architecture was simple. One rapporteur opened, sealed, expanded and judged. Challenges met the claim that the files were secret and the prevention was settled. Fux’s order treats that claim as insufficient. The 48-hour clock is already running. Pandora’s box was never supposed to be opened by anyone but its keeper. The Court has just been told otherwise.
