STF Faces Crisis After Police File Ties Justice Moraes to Banker’s Contracts and Messages

BRASILIA — On September 1, 2026, Supreme Court Justice André Mendonça lifted secrecy on a Federal Police report that places fellow justice Alexandre de Moraes inside the paper trail of Banco Master and its former owner, Daniel Vorcaro. The file does not charge Moraes with a crime. It does put his name on a nine-figure legal retainer, a second draft contract, and crisis notes Vorcaro sent as he tried to avoid arrest.
The first contract, already known in outline, is the roughly R$131 million legal-services agreement between Banco Master and Barci de Moraes Sociedade de Advogados, the firm of Viviane Barci de Moraes, the justice’s wife. According to metadata recovered from Vorcaro’s seized phone and described in the police report, an Office 365 account identified as “Ministro Alexandre de Moraes” made the last edit to the draft. The firm confirmed that Moraes reviewed the text. It said the review was a compliance check: whether he had any Supreme Court case involving the bank. The firm says he had never judged Master, so there was no legal impediment, the contract was signed, and legal work was performed. Tax records later showed Master declared about R$80 million paid to the firm before Vorcaro’s arrest and the bank’s liquidation cut off the remaining installments.
A second instrument, dated May 12, 2025, appears in the same police file. It is a draft between Barci de Moraes and Viking Participações Ltda., another Vorcaro vehicle, for up to R$50 million over 36 months. Police say the draft contemplated payment in cash or in assets, including shares tied to an Embraer Legacy 650 and a helicopter then being acquired. The firm has said this second paper was never signed and that no services or payments under it occurred. Investigators have noted that R$50 million is close to the unpaid balance on the original Master retainer.
The messages are what moved the file from contract dispute to institutional emergency. Police say Vorcaro drafted notes on his phone and sent them as disappearing WhatsApp messages to a contact saved as Alexandre de Moraes. In late October 2025 he wrote that he had confidential word from Central Bank circles that pressure from the Federal Police and prosecutors was rising, and that it was “important to reinforce with Andrei and Paulo” — understood by investigators as PF Director-General Andrei Rodrigues and Prosecutor-General Paulo Gonet — so that “no one below” would pull “a dirty trick.” Two days before his November 17, 2025 arrest at Guarulhos, as he tried to fly to Dubai, Vorcaro asked whether he already needed to be out of the country. Replies sent the same way were not recovered.
Mendonça, rapporteur of the Master case, unsealed the report, asked the Prosecutor-General’s Office for a formal position, and told the Court the material belongs in a public plenary session regardless of what prosecutors say. Opposition presidential candidates immediately called for Moraes to resign or face impeachment. No indictment of the justice has been filed. Voluntary retirement remains legally available; mandatory retirement for him is not until 2043. The Court itself has recently held that serious judicial misconduct should lead to loss of office, not a paid forced retirement.
The defense that will be tested is narrow and factual: conflict check, no Master case on his docket, work allegedly done, second contract unexecuted, one-sided messages, presumption of innocence. The attack that will be tested is also narrow: a sitting justice last-edited his wife’s huge retainer with a banker who treated those payments as his most important contract and then asked that justice for help with the police and the prosecutor’s office. Whether that is ugly ethics or a crime is now a question for the Prosecutor-General and the full Supreme Court, not for the street.
Justice that only runs downhill is not justice. The same standard that applies to a banker, a minister’s spouse, or a Supreme Court justice is the only standard that still means something when the names change. Public file, independent charging decision, open Court — not a private settlement and not a crowd sentence. Hold that line and the rest is just politics.
