Brazil: William Waack Slams STF Session

Journalist William Waack delivered a pointed commentary on Brazilian television after a turbulent session of the Supreme Federal Court, arguing that the justices themselves had already said everything necessary about the institutional crisis unfolding inside the Court. He described the close of the session as melancholic and even pathetic, highlighting Minister Cármen Lúcia’s public apology to the country and concluding that the gesture, while notable, remained insufficient.
The session itself had been called to address a Police Federal report containing dozens of messages exchanged between Justice Alexandre de Moraes and Daniel Vorcaro, the former controller of Banco Master. The report also raised questions about how another justice, André Mendonça, had handled related proceedings. Instead of producing a clear procedural decision, the hearing descended into open disagreement among the justices. Arguments over whether the two matters should be judged together or separately produced a narrow 4-3 split before a request for more time interrupted the vote. The Court left the core issues unresolved.
Cármen Lúcia, the last to speak, broke from the usual formal tone. She said she felt ashamed that, less than three weeks before national elections, public attention was fixed on the Supreme Court’s internal conflicts rather than on the country’s political choices. She spoke of a “civic malaise” generated by the Court itself and criticized the “spectacularization” of the proceedings. Quoting Clarice Lispector, she remarked that she had not lost her way but had “experienced perdition.” She then apologized to her colleagues, to the Court’s president, and to the Brazilian people, saying she wished she had done more to restore calm and that the judiciary exists to give the nation tranquility, not unease.
Waack seized on those words. In his analysis he noted that he no longer needed to add his own adjectives; the ministers’ own statements painted the picture. The session had ended not with a demonstration of institutional strength but with an admission of failure to manage its own house. The on-screen headline accompanying his comments captured the prevailing view in parts of the press: the Court, unable to decide, had only widened the crisis.
The episode arrives at a politically charged moment. The messages between Moraes and Vorcaro, spanning more than a year, have been interpreted by critics as evidence of improper proximity between a sitting justice and a businessman later arrested in a financial-fraud investigation. Defenders of Moraes argue the contacts do not prove misconduct and that the leak and subsequent public airing of the report amount to an attack on the Court. The justices’ inability to contain the debate within procedural bounds has amplified both interpretations.
Public reaction on social platforms quickly polarized. Some users treated Cármen Lúcia’s apology as a rare moment of institutional self-awareness. Others, including several replies to the clip of Waack, insisted the apology should have been directed at people they regard as political prisoners from the events of January 8, 2023, or at families affected by earlier judicial decisions. A few reminded audiences of Waack’s own past political alignments, attempting to discount his current criticism. The clip itself nevertheless circulated widely, suggesting that even viewers who disagree with Waack’s broader views found the ministers’ language striking.
The deeper problem exposed by the session is not merely one day’s disorder. Brazil’s highest court has for years occupied an unusually central role in political life, issuing decisions that reach far beyond traditional constitutional review. When that same court appears unable to conduct its own business with composure, public confidence erodes. Cármen Lúcia’s remarks acknowledged as much. Waack’s commentary simply underlined that an apology, however sincere, does not by itself restore the appearance of serenity the Court claims it should project.
Whether the justices can now lower the temperature, separate the personal from the institutional, and reach a decision that looks like law rather than factional combat will determine how lasting the damage proves to be. For the moment, the most memorable words of the day came from inside the Court itself.
