The Electoral Court Draws a Line on Paid Smears

On Friday, TSE minister André Mendonça fined Luiz Inácio Lula da Silva’s campaign R$15,000 for paying to boost a video against Flávio Bolsonaro and the Bolsonaro family. The ruling also barred the campaign from buying more reach for the same material on any platform.
That is not a ban on criticism. It is a ban on using paid amplification as a weapon.
The video said the Bolsonaro family “left Brazil more violent,” claimed more than one million guns and one billion bullets had been put on the streets, tied some of that armament to criminal factions, and closed with “Bolsonaros, never again.” Mendonça found the piece was built from start to finish to disqualify Flávio. It did not compare proposals. It did not promote Lula’s own record. It was negative propaganda, purchased and scaled.
Electoral law in Brazil already limits paid boosting to promotional content that benefits the candidate who pays for it. Organic posts can still circulate. Harsh political speech can still be made. What cannot be bought is a paid megaphone for an attack ad dressed up as public debate.
The numbers explain the penalty. The campaign spent an estimated R$8,200 to R$9,299 and reached about 660,000 to 770,000 impressions. Mendonça set the fine above the legal minimum because the paid reach was large enough to matter.
Conservatives who care about elections should treat this as a rules case, not a personality contest. Campaigns that hold office and command large digital machines have every incentive to flood feeds with paid hostility. If the law allows that for one side, it becomes a spending arms race in slander. If the law forbids paid negative boosting for everyone, voters still hear the argument. They just hear it without a purchased algorithm pushing it into hundreds of thousands of timelines.
Mendonça has made the same distinction before. He has blocked paid or unproven associations of politicians with organized crime when the posts lacked a minimum factual basis, while repeating that political criticism of security policy remains lawful. That consistency is the only standard that lasts past one news cycle.
The left will call the fine censorship. The text of the decision says the opposite: organic circulation is not barred, and criticism of Flávio, Jair Bolsonaro, or “Bolsonarismo” is not barred. What was barred was the purchase of extra distribution for a negative piece. That is a narrower rule than many democracies apply to campaign advertising.
A healthy conservative position is simple. Enforce the same advertising rules on every ticket. Do not confuse a paid smear with free speech. Let voters judge families, crime policy, and records on evidence, not on who can rent the largest digital loudspeaker.
