On October 2, 2026, Edson Fachin, president of Brazil’s Supreme Federal Court, published Resolution 921/2026. The measure installs a technical filter under the presidency: petitions filed by people who are not parties to an ongoing case must be checked before they can be stapled onto that case. If the reviewers decide there is no direct link, the filing is spun off as a brand-new action and sent to lottery distribution or ordinary prevention rules. The timing is impossible to miss. The resolution landed one day after Gilmar Mendes, acting on a petition lodged by the Solidariedade party inside an existing case under his rapporteurship, ordered the inclusion of presidential candidate Renan Santos of the Missão party in a TV Globo debate that the network later canceled. Jornal da Cidade Online framed the new rule as the end of Gilmar’s “farra.” Gazeta do Povo and other outlets noted parallel recent filings that had reached Flávio Dino and Luiz Fux the same way. Fachin’s text itself cites the need to protect random distribution and the principle of the natural judge.
Here is the loud part the resolution does not say: the filter is narrow. It leaves monocratic decisions untouched. It leaves prevention routing in place. It leaves ordinary party filings, document drops, and internal appeals largely alone. The judgment of what counts as a “sufficient connection” stays inside the same court. Earlier distribution tweaks, including one Fachin issued in May covering closed cases, did not stop the practice in live dockets. Enforcement still depends on the institution whose internal habits produced the complaints.
The original skepticism posted on X — doubt that a so-called “gang of four” will follow Fachin — tracks the structural limit. A screening desk can make the most blatant third-party inserts harder and more visible. It does not dissolve the concentration of urgent power in individual rapporteurs or the political pressure that rewards speed over random assignment. Whether the rule changes outcomes will be measured by how many borderline petitions are actually reclassified and whether strategically timed requests simply arrive by other doors.
