    Judge Moraes Breaks the Law to Keep a Conservative in Jail

    Judge Moraes Breaks the Law to Keep a Conservative in Jail

    Judge Alexandre de Moraes, from Brazil’s Supreme Court, is doing something very bad. He is ignoring requests from the lawyers of Filipe Martins. Filipe used to help former President Jair Bolsonaro with international matters.

    This is now the fourth time the defense asked to end or make easier Filipe’s preventive prison (jail before final trial). Moraes just does nothing about it. He seems to work only when he wants to punish people he does not like.

    Filipe was first in house arrest (jail at home with rules). One big rule: no using social media. Moraes said Filipe broke this rule by using LinkedIn. So he changed house arrest to full prison on January 2, 2026.

    But the defense showed strong proof from Microsoft (the company that owns LinkedIn). The proof says: Filipe did not log in to LinkedIn since September 2024. That is more than one year **before** the no-social-media rule started! The last login was old. So Moraes made a big mistake with wrong facts.

    The lawyers sent this proof more than 10 days ago. They asked Moraes to look at it and free Filipe or fix the error. Moraes still ignores it.

    In Brazil, the law is clear and simple:
    – Preventive jail must be checked every 90 days. If not, it becomes illegal.
    – A judge must decide fast on requests about freedom.
    – The Constitution says no one can stay in jail illegally. The judge must fix it right away.

    When a judge ignores these requests for a long time, it is wrong. It can be called “illegal constraint” (keeping someone in jail without good reason). The defense can ask higher courts for help.Many people say Moraes does this on purpose. He wants to keep conservatives like Filipe in jail longer. He punishes people who support Bolsonaro. This looks like abuse of power.

    Conservatives are angry. They say: “This is not justice. This is revenge.” Filipe is treated like a political prisoner. The judge should follow the law, not ignore proofs and requests.Brazil needs real justice for everyone — not special rules only against one side. Moraes must stop this and decide the requests now. If he keeps ignoring them, it shows he cares more about power than the law.
