    Spain Frees Brazilian Businessman After Moraes’ Extradition Request Over Wife’s Tax Data

    Spain’s Audiencia Nacional has released businessman Marcelo Conde, detained in Madrid since May on an extradition request signed by Brazilian Supreme Court Justice Alexandre de Moraes. The case involves accusations that Conde financed the illegal purchase of confidential tax records belonging to Viviane Barci de Moraes — the justice’s own wife — and hundreds of other high-profile Brazilians.

    Investigators say Conde provided lists of taxpayer identification numbers and paid 4,500 reais in cash to obtain fiscal declarations extracted from Federal Revenue and Coaf systems. The scheme allegedly reached 1,819 people, including Supreme Court justices, their relatives, the attorney general, lawmakers, and business figures. Some of the documented accesses involving Viviane Barci were limited to basic registration details such as her full name, CPF, mother’s name, and date of birth. Other records concerned fuller tax declarations and financial information.

    Authorities claim the data was obtained so it could be leaked to journalists. The resulting coverage included reports that Barci’s personal net worth rose from 24 million reais to 79.7 million reais in a single year, driven in part by a 57-million-reais profit distribution from her law firm, as well as details of the firm’s large contract with Banco Master. Brazilian prosecutors have described the leaks as an attempt to create “artificial suspicions” against public officials and their families. Conde has denied any involvement and called the Brazilian proceedings “truculent.”

    The Spanish court noted that the extradition request came from “the Supreme Federal Court Office of Alexandre de Moraes.” In most legal systems a judge whose spouse is named as a victim would recuse himself. Moraes did not. He authorized the arrest warrant, searches, and the international request while remaining at the center of the inquiry.

    This episode sits against a backdrop of public questions about Viviane Barci’s law firm and its reported 129-million-reais contract with Banco Master. Tax authorities recorded tens of millions of reais in payments to the firm. Critics have asked whether the appearance of influence and the justice’s dual role in related investigations undermine confidence in impartiality.

    Democratic institutions depend on judges who recuse themselves when personal interests are at stake. When a single justice can both pursue an alleged leak of his wife’s records and demand another country’s cooperation, the appearance of concentrated power becomes difficult to ignore. Spain’s decision is a reminder that other democracies still apply basic conflict-of-interest rules.
