Estadão and G1 reported that metadata on a seized file show Moraes himself last edited a roughly R$129–131 million legal-services contract between Vorcaro’s bank and the law firm of his wife, Viviane Barci de Moraes. The firm’s compliance note claims Moraes was consulted only to confirm he had no pending cases involving the bank. Critics, including Senator Flávio Bolsonaro, called the arrangement a conflict that distorts due process at the highest level of the judiciary.
Mendonça, the case rapporteur and a justice appointed during the previous administration, has already sent an official request to the Prosecutor-General’s Office demanding clarification within five days. He is now weighing a further step that only the full 11-member Court can authorize: opening an investigation of a sitting justice. CNN Brasil’s Caio Junqueira reported that Mendonça’s allies currently count three likely votes for authorization (President Edson Fachin, Nunes Marques, and Luiz Fux) against three expected to protect Moraes (Cristiano Zanin, Flávio Dino, and Gilmar Mendes). The Federal Police leadership could come under renewed scrutiny. If the Court refuses to open the inquiry, the opposite message would be sent: that the institution will close ranks when one of its own is implicated. Public trust in the judiciary, already strained by years of accusations of activism and selective enforcement, would suffer another blow. Calls for resignation or impeachment, already voiced in the Senate, would intensify.
What happens next is procedural but high-stakes. The Prosecutor-General’s five-day response will determine whether Mendonça proceeds to President Fachin with a formal request. Behind-the-scenes vote-counting and pressure campaigns will accelerate. Additional documents or testimony from Vorcaro could still surface. The Court has never in its modern history authorized a full investigation of a sitting justice; doing so now would be historic. Declining to do so would also be historic, in a different way.
