The Supreme Court Is Not the Ballot Box

Brazil’s electoral court exists for a reason. The TSE was designed to run elections, apply electoral law, and settle disputes closest to the vote. The STF exists to interpret the Constitution. Those roles are not interchangeable. When a Supreme Court justice treats the electoral court as a junior body that can be overridden “whenever necessary,” the line between law and power starts to disappear.
Justice Gilmar Mendes did not merely call for impartiality. After public clashes with justices now leading the TSE, he warned that members who engage the court in partisan activity should reconsider whether they belong there. He then made the larger claim: the STF will act as a supervisory instance and intervene to preserve its own precedents and the Constitution. That is not a routine reminder of judicial hierarchy. It is a signal that election-related decisions can be rewritten from above if they conflict with what the Supreme Court majority prefers.
That is the problem. Elections are not won in chambers. They are won by voters. If the court that counts the votes can be second-guessed after the fact by another court that was not chosen to administer the contest, the people’s choice becomes provisional. A result that survives only until a higher bench dislikes it is not a result. It is a draft.
Respect for TSE decisions is not an attack on the Constitution. It is how constitutional order works in an election year. The STF can review genuine constitutional questions. It should not convert every political disagreement into an emergency that justifies rewriting the electoral process. Once “supervision” becomes a standing threat, candidates, parties, and voters learn a different lesson: the decisive audience is no longer the electorate.
If a justice frames possible foreign interference as serious and then names internal politicization of the TSE as even more serious, while simultaneously asserting the power to override that court, the public is entitled to ask what “impartiality” means. Impartiality cannot mean one set of justices policing another set of justices who happen to preside over the election. That is not neutrality. That is a struggle over who controls the referee.
Democracy is not the right of courts to correct the public. It is the right of the public to choose, under rules known in advance, through institutions created for that purpose. When those institutions are told they may be displaced whenever a higher court deems it necessary, the vote is no longer final. The people’s voice is reduced to an opening argument.
The STF should respect TSE decisions. If the Supreme Court claims the power to interfere in the election itself, there is no meaningful democracy left. Either the ballot decides, or the bench does.
