Brazilian Party Seeks U.S. Content Takedown Through Electoral Court

A U.S.-based news outlet operating from South Florida received notice this week that a Brazilian political party has asked Brazil’s Superior Electoral Court to order the immediate removal of its posts about the 2026 Brazilian presidential election and the prediction market Polymarket. The request, filed by Partido Missão and its candidate Renan Santos, also sought daily fines if the content remained online.
X forwarded the legal notice to UHN Plus. Justice André Mendonça declined to issue an immediate takedown and postponed a ruling until the parties could be heard. UHN Plus said it would defend its editorial independence and continue reporting on Brazil from the United States.
The filing also named other foreign accounts and asked the court to block Polymarket advertising related to the Brazilian race. Partido Missão argued the posts constituted unauthorized paid electoral propaganda and the use of foreign resources, both restricted under Brazilian election rules. Polymarket, a U.S. prediction market, is banned inside Brazil.
From the American free-speech perspective, the episode raises a direct conflict between Brazilian electoral regulation and the First Amendment. U.S. law treats political speech, including coverage of foreign elections and discussion of betting markets, as core protected expression. American courts have long resisted enforcing foreign judgments that would punish speech lawful in the United States. The SPEECH Act of 2010 already bars recognition of certain foreign defamation awards that fail to meet First Amendment standards; similar principles apply when a foreign court tries to reach content created and published on U.S. soil.
A U.S. news organization based in Florida is not a Brazilian campaign entity. Its reporting originates under American jurisdiction. Compelling a U.S. platform to suppress that reporting at the request of a Brazilian court would amount to extra-territorial speech regulation. Platforms face practical pressure because they operate globally and can lose access to the Brazilian market, but that commercial reality does not change the constitutional status of the speech itself.
The case illustrates a growing pattern: governments using their own courts and regulatory bodies to demand that American companies police speech about their domestic politics. Whether X ultimately complies or resists will test how far U.S. platforms are willing to export foreign speech restrictions back into the American information environment.
UHN Plus has stated it will not alter its coverage in response to the legal pressure. The postponed ruling leaves the immediate demand unresolved, but the filing itself already demonstrates the reach Brazilian electoral authorities are attempting to claim over foreign media.
