    Brazil: 76 Parliamentarians DENOUNCE Moraes in the OAS for “Tyrannical Acts”

    Parliamentarians take accusation against Moraes to the OAS

    A group of 76 parliamentarians, composed of 63 federal deputies and 13 senators, presented a petition to the Inter-American Commission on Human Rights (IACHR) of the Organization of American States (OAS) against Minister Alexandre de Moraes and the Supreme Court (STF). The action denounces “tyrannical acts” practiced in criminal proceedings against those investigated by the events of January 8.

    The document accuses Moraes of conducting the trials arbitrarily, violating articles of the American Convention on Human Rights. Among the complaints, the parliamentarians cite prolonged arrests, procedural maneuvers and alleged judicial omissions.

    Criticisms to the  conduct of processes

    The signatories of the request argue that the Supreme Court exceeded its attributions, by judging individuals who do not have a privileged forum. They also maintain that Moraes accumulated functions incompatible with a fair trial, acting simultaneously as a victim, investigator and judge.

    The petition highlights that the January 8 protests were promoted by unarmed demonstrators without military support, questioning the classification of the act as an attempted coup d’état. The parliamentarians claim that there was no real risk to the functioning of the democratic institutions, since the Three Powers were in recess.

    Deaths and prolonged arrests are also in the complaint

    Another point addressed in the document is the death of Cleriston Pereira da Cunha, the Clezão, one of the detainees in relation to the events of January 8. He died in the Papuda Complex after suffering a sudden illness. According to the parliamentarians, Moraes ignored requests for house arrest, which would have resulted in his death.

    Parliamentarians ask for measures

     

    The initiative reflects an escalation of the clash between parliamentarians and the top of the Judiciary. The sending of the complaint to the OAS indicates that the signatories seek international pressure against the performance of Moraes and the Supreme Court.

    Congressmen maintain that the OAS should evaluate allegations of violation of fundamental rights, based on the American Convention on Human Rights. It remains to be seen what the international body’s response will be to the accusations against Moraes and the Supreme Court.
