A Conservative Victory for Due Process: De Moraes’ COAF Review and Its Implications for Bolsonaro’s Cases

    By Hotspotorlando News

The recent announcement by Supreme Court Justice Alexandre de Moraes to review the suspension of legal processes relying on Brazil’s Financial Activities Control Council (COAF) reports is a development conservatives should cautiously celebrate. Sparked by an alert from MP Luiz Philippe de Orleans-Bragança, this move signals a rare check on judicial overreach and could have significant implications for former President Jair Bolsonaro’s ongoing legal battles. While the outcome remains uncertain, this review underscores the importance of safeguarding due process, curbing institutional bias, and preserving the rule of law in Brazil’s polarized political landscape.

From a conservative perspective, the COAF suspension saga has been a troubling example of the Supreme Federal Court’s (STF) tendency to wield unchecked power. COAF, a critical tool for tracking suspicious financial activity and combating corruption, has been instrumental in uncovering elite malfeasance—something conservatives have championed since the days of Operation Lava Jato. Yet, the STF’s decision earlier this year to halt processes dependent on COAF reports, citing privacy concerns and procedural flaws, raised red flags. The blanket suspension risked paralyzing legitimate investigations while potentially shielding those guilty of financial crimes, all under the guise of protecting individual rights. For conservatives, this move reeked of selective justice, especially given the STF’s track record under de Moraes, who has been accused of targeting conservative figures like Bolsonaro with disproportionate zeal.

MP de Orleans-Bragança’s alert, which prompted this review, is a testament to the power of conservative voices holding the judiciary accountable. A staunch defender of limited government and constitutional principles, the MP rightly called out the suspension’s overreach, arguing it undermined Brazil’s anti-corruption framework. His intervention aligns with the conservative belief that institutions must serve the people, not act as tools for political vendettas. The fact that de Moraes, a figure often at odds with conservative ideals, felt compelled to respond suggests that public pressure and legislative oversight can still influence Brazil’s judicial behemoth.

For Jair Bolsonaro, the stakes are high. The former president faces a barrage of investigations, most notably the Operation Tempus Veritatis probe into an alleged coup plot following his 2022 election loss, alongside inquiries into misinformation and financial irregularities. While not all of these cases hinge directly on COAF data, some—particularly those involving funding for protests or alleged criminal networks—could be affected. The review offers a glimmer of hope for Bolsonaro and his supporters. If de Moraes upholds or expands the suspension, it could delay or weaken cases where COAF reports were used without proper oversight, bolstering Bolsonaro’s defense that he’s being politically persecuted. Even a partial rollback of the suspension could force prosecutors to re-evaluate evidence, giving Bolsonaro’s legal team breathing room to challenge what many conservatives see as trumped-up charges.

However, conservatives should temper their optimism with vigilance. De Moraes is no ally of the right. His history of censoring conservative voices on platforms like X, ordering arrests in the January 8 riot cases, and pushing for swift action in the coup probe suggests he’s unlikely to hand Bolsonaro a clear win. The review could be a tactical maneuver—placating critics while quietly reinstating COAF reports in cases deemed “essential” to public security, which often align with the STF’s anti-Bolsonaro agenda. If the review results in tighter rules for COAF use but allows key evidence to stand, it could accelerate prosecutions, putting Bolsonaro at greater risk of conviction before the 2026 elections.

Still, this moment is a conservative triumph in principle. It reaffirms that judicial decisions, no matter how entrenched, can be challenged when they threaten justice or overstep constitutional bounds. For Bolsonaro, the review might not dismantle the STF’s pursuit but could expose flaws in its approach, reinforcing the narrative of a biased judiciary. More broadly, it’s a reminder that conservatives must continue advocating for transparency, accountability, and fairness in Brazil’s institutions. The fight against corruption shouldn’t mean trampling due process, nor should privacy protections become a shield for the guilty. As de Moraes’ review unfolds, conservatives should rally behind leaders like de Orleans-Bragança, demand clarity on COAF’s role, and ensure that Bolsonaro—and all Brazilians—receive a fair shake under the law. In a nation where trust in institutions hangs by a thread, this review is a chance to restore balance, and conservatives must seize it.
