When the Referee Writes the Contract: Alexandre de Moraes, Banco Master, and the Crisis of Brazil’s Highest Court

A Supreme Court justice cannot be a silent partner in the fortunes of a banker under investigation. That is not a partisan slogan. It is the minimum standard of institutional hygiene in any country that still pretends to have a separation of powers. The revelations published this week about Justice Alexandre de Moraes and Banco Master do not merely raise an appearance of impropriety. They describe a web of money, access, and private messages that would destroy the career of a mid-level prosecutor anywhere else.
The facts, as reported by O Estado de S. Paulo, O Globo, VEJA, CNN Brasil, and Federal Police material now before the Supreme Court, are straightforward.
In early 2024, the law firm of Viviane Barci de Moraes — the justice’s wife — signed a legal-services contract with Banco Master, then controlled by Daniel Vorcaro. The deal was worth about R$131 million over three years, structured as monthly payments of roughly R$3 million net. The firm later confirmed it received more than R$80 million before the Central Bank liquidated the bank in November 2025. The contract was not a narrow opinion letter. Investigators say it contemplated work before the Federal Police, the Central Bank, the tax authority, and other agencies — exactly the institutions that would later move against Vorcaro.
Metadata extracted from a file found on Vorcaro’s seized phone show that the last edits to that contract were made on the evening of January 15, 2024, under an Office 365 profile named “Ministro Alexandre de Moraes.” The firm’s own statement acknowledges that compliance staff consulted the justice, “in his capacity as husband of the managing partner,” to check for legal impediments. The firm says he found none because he had never sat on a Master case. That answer is legally tidy and institutionally bankrupt. A justice of the Supreme Federal Court should not be line-editing a nine-figure contract that his household will collect from a private bank. The fact that the bank later collapsed amid allegations of a multi-billion-real hole only makes the optics worse.
The money did not stop at legal fees. According to a Federal Police report cited by VEJA and Estadão, in October 2025 — weeks before Vorcaro’s first arrest — an employee of the Barci firm asked the banker for credit cards for Moraes’s children, Giuliana and Alexandre Barci de Moraes. The limit requested was R$300,000 each. Vorcaro answered with a one-word authorization: “Ok.”
Then come the messages. Federal Police material reviewed by Estadão, O Globo, and Metrópoles shows Vorcaro writing to Moraes as the investigation closed in. He asked whether they could “revert this with Paulo or Andrei” — references investigators identify as Prosecutor-General Paulo Gonet and Federal Police Director-General Andrei Rodrigues. He asked if Andrei could delay an operation by a week so “the bank doesn’t break.” On the morning of his first arrest, November 17, 2025, as he tried to board a private jet bound for Dubai, Vorcaro messaged the justice asking whether he had managed to “get news or block” the move. Justice André Mendonça has now forwarded that report to the Prosecutor-General’s Office and given it five days to respond.
Moraes has previously said his meetings with Central Bank President Gabriel Galípolo were solely about the consequences of U.S. Magnitsky sanctions imposed on him in July 2025 and later lifted in December. Those meetings occurred in the same period when reports in O Globo described him as pressing for approval of a rescue sale of Master to the publicly owned Banco de Brasília. A justice sanctioned abroad for alleged abuses of process was simultaneously discussing banking access with the regulator of a bank that was paying his family tens of millions of reais. The two stories cannot both be complete.
None of this requires a conspiracy theory. It requires only the conservative premise that power must be checked by rules that apply to the powerful. Moraes spent years presenting himself as the indispensable guardian of Brazilian democracy. He led the most politically charged cases of the decade. He issued orders that silenced accounts, froze assets, and shaped the public square. A man in that position cannot accept — or even appear to accept — a private financial pipeline from a banker who later begged him to lean on the police and the prosecutor’s office.
Senator Flávio Bolsonaro called for Moraes’s resignation on Tuesday. That demand will be dismissed in Brasília as opportunistic. The institutional question does not depend on who makes it. If a Supreme Court justice can review his wife’s contract with a bank, receive luxury credit facilities for his children from that bank’s owner, fly on aircraft linked to the same circle, and then receive WhatsApp pleas to slow a police operation, the court is no longer a court. It is a faction with robes.
Brazil does not need another cycle of selective outrage. It needs a simple rule: no justice may have a household financial interest in a party that may come before the state. The Barci-Master contract, the metadata, the credit cards, and the messages fail that test in public view. Either the Supreme Court polices itself, or the political branches will eventually do it for them — messily, late, and at the cost of whatever legitimacy remains.
