    Spain justice rejects Oswaldo Eustáquio’s arrest requested by the Supreme Court by Supreme Court Justice.9

    Justice of Spain made a significant decision by denying the request for preventive detention against journalist Oswaldo Eustáquio. This request had been made by the minister of the Supreme Court (STF) of Brazil, Alexandre de Moraes. The confirmation of the decision was given by Eustáquio’s defense lawyer, Ricardo Vasconcellos, to Revista Oeste.
    The arrest warrant was sent by Itamaraty and was part of a process that sought to ensure the journalist’s arrest so that he could respond to an extradition process. Moraes had accused the journalist of disobeying court orders by continuing to use social networks, something that the defense denies, stating that Eustáquio is not active on social networks in Brazil.

    The request for preventive detention against Oswaldo Eustáquio arose in the context of an ongoing judicial process. Minister Alexandre de Moraes, of the Supreme Court, claimed that Eustáquio was disrespecting court orders by maintaining activity on social networks. However, the defense argues that he is not using these platforms in Brazil, which raises questions about the validity of the accusations.

    In February, a hearing that was scheduled to discuss the case was canceled by the Spanish Justice. However, a new hearing was held recently, where Eustáquio had the opportunity to present his version of the facts, describing the situation as a “good opportunity” to expose what he considers to be a political persecution since 2020.

    During the hearing held in Spain, Oswaldo Eustáquio’s defense also requested the suspension of the extradition process until the journalist’s request for political asylum is judged. The Spanish court’s decision was to release Eustáquio without imposing any precautionary measure, which represents a temporary relief for the journalist.

    This decision is seen as an important step for Eustáquio, who seeks legal protection while facing the charges in Brazil. The suspension of the extradition process is crucial to ensure that his asylum application is properly evaluated before any additional action.

    With the decision of the Spanish Justice not to apply precautionary measures, the future of Oswaldo Eustáquio’s case still remains uncertain. The defense continues to work so that the request for political asylum is considered before any extradition. Meanwhile, the journalist awaits the next legal steps that will determine his status in both Spain and Brazil.

    The Eustáquio case highlights complex issues involving human rights, freedom of expression and international judicial proceedings. Attention now turns to future decisions that may impact not only the journalist’s life, but also the diplomatic relations between the two countries.
