Brazil: Three Hours in Lago Sul
When the justice who needs protection meets the senator who holds the key
On Wednesday, September 2, Justice Alexandre de Moraes spent three hours at the home of Senate President Davi Alcolumbre in Lago Sul, Brasília. The meeting was reported by columnist Malu Gaspar in O Globo, confirmed by three sources familiar with the crisis, and later corroborated by Metrópoles. It took place before the STF plenary session that day — and immediately before Moraes launched his counter-offensive against fellow Justice André Mendonça.
That sequence is the story. Not a rumor. Not a theory. A reported meeting, then a legal strike.
Moraes used the long-running Fake News inquiry — an investigation he himself reports — to accuse Mendonça of abuse of authority, administrative improbity, and directing probes for personal and political reasons. Central to that accusation was a Federal Police intelligence assessment that listed Alcolumbre as a “probable strategic target.” Why? Because the Senate president controls whether impeachment requests against Supreme Court justices ever reach the floor.
In other words: Moraes sat for three hours with the man his own filing described as Mendonça’s next target, then filed against Mendonça.
O Globo sources went further. They said Moraes was “paving the way” for Alcolumbre to put an impeachment of Mendonça on the agenda. Alcolumbre, the same report noted, had already been telling allies that if anyone at the Court should face impeachment, it should be Mendonça — not Moraes.
The public performance that followed the meeting fits the same pattern. Alcolumbre returned to the Senate, complained of “aggressions,” defended Moraes, and reminded the chamber that Flávio Bolsonaro had sought money from the same banker, Daniel Vorcaro, for the film Dark Horse. That is the talking point used to dilute the scandal around Moraes: everyone talked to Vorcaro, so no one should be singled out. It is a political argument. It is not a legal defense of a justice meeting privately with the politician who can bury his impeachment.
The document Moraes relied on does not rescue the appearance. Folha and other outlets reported that the PF material was unsigned, described internally as lacking evidentiary value, and warned that it should not be used to ground external proceedings. Moraes used it anyway — against a colleague, inside an inquiry he controls, after a private meeting with an interested politician.
STF President Edson Fachin has already taken the request out of Moraes’s Fake News inquiry and given the Prosecutor General and Mendonça five days to respond. That is the institution trying to stop one justice from judging his own feud. It does not erase the meeting.
Moraes’s legal strategy
What Moraes filed was not a conventional criminal case. It was a strategy to regain control of the forum and the story after Mendonça exposed the Vorcaro problem.
The first move was the vehicle. He did not ask the full Court, in a clean new proceeding, to examine Mendonça. He filed inside Inquérito 4.781, the 2019 Fake News inquiry he has reported for years. That file has already been stretched far beyond its original purpose. Using it let him cast Mendonça as a threat to the Court rather than as the colleague who had just put Moraes on defense. It also let him keep secrecy, timing, and the first written framing in his own hands.
The second move was the evidence. He did not wait for a signed police inquiry or a Prosecutor General charge. He used PF intelligence notes that named Alcolumbre as a probable target, suggested Mendonça was steering investigations for political reasons, and were reported as internally unfit to support an external case. That kind of paper can start a conversation. It is a weak foundation for accusing a sitting justice of improbity, abuse of authority, and a crime of responsibility. It is, however, fast. Speed was the point.
The third move was the legal theory. Moraes packed several accusations into one petition: that Mendonça usurped police and prosecutorial functions; that he chose targets unevenly; that Moraes and Alcolumbre were singled out for personal and political reasons; and that the Court had to defend itself. The Alcolumbre passage is the hinge. By turning the Senate president into a victim of Mendonça’s alleged bias, Moraes converted a political ally into a legal exhibit. Crime-of-responsibility language is Senate language. It is what you write when the real audience is not only the Court, but the man who decides impeachment.
The fourth move was timing. The reported order is the strategy: the Vorcaro material surfaces; Moraes confronts Mendonça; intelligence on Mendonça’s methods is requested or received; Moraes meets Alcolumbre for three hours; Moraes files in his own inquiry and sends it to Fachin “for appropriate measures.” Sending the file upstairs looks deferential. In practice it delivered a finished accusation after the narrative had already been set.
From Moraes’s side, success would have meant keeping the fight inside the Fake News inquiry, making Mendonça’s methods the scandal, giving Alcolumbre a pretext to stall impeachment of Moraes and float impeachment of Mendonça, and shrinking Mendonça’s room to keep pushing Banco Master and INSS toward Moraes’s circle. The institutional argument buried in that plan is not empty. A rapporteur should not turn a financial investigation into a hunt against another justice without the Prosecutor General and the full Court. Moraes is trying to make procedure the issue so that his messages with Vorcaro stop being the issue.
The strategy is weaker where it counts. The target is the justice who just exposed him. The key “victim” in the petition is the politician he just met. The vehicle is his own old inquiry. The proof is a document the PF itself reportedly said should not be used that way. Fachin saw the forum problem and stripped Moraes of rapporteur control. Once the case sits with the Presidency and the PGR, Moraes no longer writes the next order. If the Prosecutor General says the procedure was irregular, the filing becomes an internal quarrel rather than a case against Mendonça.
There is a further risk. A counter-attack that does not kill the original facts keeps those facts alive. Every day this is Moraes versus Mendonça is another day the Vorcaro chats remain on the table. And the Senate half of the plan still depends on Alcolumbre. If the meeting itself makes Alcolumbre even more cautious until after the election, Moraes gets delay, not clearance.
Conservatives do not need a hidden transcript to see the design. A Supreme Court justice under scrutiny for contacts with a failed banker does not get to hold a three-hour private session with the Senate president who decides whether that justice can be impeached, then accuse the investigating colleague of politicizing the case inside an inquiry he himself reports. That is not checks and balances. That is the referee meeting the team owner before throwing the other player out of the game.
Alcolumbre has spent months refusing to schedule the pile of impeachment requests against Moraes. He says the “appropriate moment” comes after the election. Elections matter. So does the appearance that the man delaying accountability and the man seeking protection spent three hours aligning the next legal move.
The Brazilian people are not required to pretend this is normal. A Court that investigates everyone except its own allies, and a Senate president who protects the justice who protects him, is not a system of laws. It is a system of friends.
