Brazil’s Electoral Court Tightens Grip on Speech

    By Hotspotnews

In the closing days of Brazil’s 2026 presidential runoff, the Superior Electoral Court demonstrated its willingness to restrict online content at the request of political actors. A widely shared notice showed that a post was made unavailable inside Brazil solely because of a legal demand from the Tribunal Superior Eleitoral. Eduardo Bolsonaro, the most-voted federal deputy in Brazilian history and now living in the United States, responded with a pointed question: “Is it a democracy???” The episode fits a familiar pattern in which unelected judges step into the political arena and platforms promptly comply.

Throughout the campaign the TSE processed a record volume of takedown requests—more than triple the number filed at the comparable stage of the 2022 election. While the court has ordered removals from both the Lula and Flávio Bolsonaro campaigns, conservative observers note that the heaviest procedural burden and the broadest chilling effect continue to fall on opposition voices. Ministers have justified the orders by claiming certain statements lack a “minimum factual basis,” yet critics argue that the standard is applied unevenly and that the court itself has become an active participant in the contest rather than a neutral referee.

The same institution that once blocked entire social-media accounts and threatened platform-wide restrictions normalized geo-blocking individual posts, effectively creating a two-tier internet inside Brazil.

For many on the right, the pattern confirms long-standing concerns about judicial activism that began under previous left-leaning governments and has continued under Lula. When the country’s highest electoral authority can silence commentary with a single request and platforms obey without public debate, the practical space for democratic contestation shrinks. Eduardo Bolsonaro’s brief question captures a view held by millions of Brazilians: repeated judicial interventions of this kind erode, rather than protect, the conditions of free and open elections.
