Senate Silence Meets Magno Malta: The Impeachment Question Brazil Cannot Dodge

On Tuesday, September 1, Senator Magno Malta (PL-ES) took the Senate floor and refused to treat the latest Banco Master revelations as just another political skirmish. He called the picture that emerged from the Federal Police report a “quadro dantesco” — a Dantesque scene — and announced he would file yet another impeachment request against Supreme Court Justice Alexandre de Moraes.
Malta did not mince words. He said a Supreme Court minister whose wife’s law firm received more than R$130 million from Daniel Vorcaro’s bank, and who himself edited the contract on a Court computer, “should be in prison at this moment.” He accused the Senate of sitting quietly “as if it had nothing to do with this.” His closing line was institutional, not theatrical: “We are not here to shame the Brazilian people. Only this House can fix Brazil.”
The facts that prompted the speech are now public. Messages recovered from Vorcaro’s phone show the banker asking Moraes whether he should leave the country two days before his arrest, seeking intervention with the Federal Police and the Prosecutor-General’s Office, and describing a “lifetime debt” of gratitude. Investigators identified at least six meetings. Metadata on the R$131 million contract with Viviane Barci de Moraes’s firm shows it was opened on the minister’s STF Office 365 account. Credit cards with high limits were issued to Moraes’s children. These are not opposition talking points; they come from a police report whose secrecy was lifted by Justice André Mendonça, the case rapporteur.
Opposition senators answered with new filings. Carlos Viana presented what he called the 54th impeachment request against Moraes and warned he would move against Senate President Davi Alcolumbre if the petition is simply shelved. Other senators from the Republicanos, PP and PL benches echoed the demand for the Senate to exercise its constitutional duty.
Alcolumbre’s response was characteristic. He declined to comment on the messages themselves — “I found nothing. I should find nothing” — and instead noted that 109 impeachment requests against the ten sitting justices are pending. “That is not normal,” he said. Allies made clear he has no intention of placing any of them on the agenda now. The Senate president holds the exclusive gatekeeping power: without his decision to open the process, there is no special committee, no temporary suspension vote, and no trial.
That is the current situation in one sentence. The Constitution gives the Senate the power to process and judge a Supreme Court minister for crimes of responsibility, including the power to suspend him pending trial. The man who controls the agenda has so far declined to use it.
What to expect is therefore institutional inertia unless the political cost of inaction rises sharply. The October elections will change the Senate’s composition. Lula’s circle has already moved to distance the president from Moraes to avoid “contamination.” Alcolumbre must still assemble a majority for his own reelection as Senate president in February 2027. Those two calendars — electoral and institutional — will decide whether Malta’s speech remains a protest or becomes the opening of a formal process.
The conservative case is straightforward. No official, including a Supreme Court justice, is above accountability when evidence of proximity to a banker later imprisoned for a multi-billion-real fraud is this detailed. The Senate was given this power precisely so that the Court would not investigate itself. Refusing to even begin the process does not protect institutions; it confirms the suspicion that they protect each other.
