    Testimony from a former TSE adviser before the Senate Public Security Committee has brought to light something many Brazilians have long suspected: Justice Alexandre de Moraes allegedly ordered the creation of a backdated report to justify a Federal Police operation against businessmen who exchanged messages critical of the government and the 2022 election process. According to the witness, the document presented as the legal foundation for the decision was produced days after the raids had already taken place.

    This is not a minor clerical issue. It is the difference between a judge who rules on existing evidence and a judge who manufactures the evidence after the fact. The report used to support the operation against the “Empresários & Política” WhatsApp group appears to have been altered to give an appearance of legality to a measure that originally rested on little more than a news article. Moraes maintains that every action was official and regular. The file metadata and screenshots presented to the committee point in the opposite direction.

    The pattern is familiar. Operations against Bolsonaro supporters, account blocks, secrecy-breaking orders, and open-ended inquiries have become routine under the same justice who simultaneously investigates, accuses, and judges. Each new revelation — each swing of the hoe — turns up another worm: unofficial reports, informal requests to the electoral court, and now the suspicion of document fraud. The Senate heard the testimony. The remaining question is whether the committee will treat this as political theater or demand the institutional consequences the gravity of the facts requires.

    The core claims come from reporting by Folha de S.Paulo (September 2, 2025) on testimony by Eduardo Tagliaferro, former head of the TSE’s Special Advisory on Combating Disinformation, given to the Senate Public Security Committee. Tagliaferro stated that a technical report used to justify the August 2022 Federal Police operation against the “Empresários & Política” WhatsApp group was produced after the raids and given an earlier date. Subsequent independent reporting (including forensic analysis of file metadata published by A Investigação) corroborated that the document attributed to a Federal Police delegate carried a creation date several days after the operation. Justice Alexandre de Moraes has maintained that all measures were official and regular.
