    Desperation Has a Voice. It Sounds Like That.

    Brazil’s highest court is supposed to speak the language of the Constitution. On Tuesday it sounded more like a back-room warning.

    According to a column by Andreza Matais in Metrópoles, Justice Gilmar Mendes reacted to reports that he might be pressured over an alleged link between his former brother-in-law, Chiquinho Feitosa, and banker Daniel Vorcaro. Mendes’ reported reply: “By the rules, you don’t make a pact with a blackmailer. Either you kill or you die.” The message, the column said, reached Court President Edson Fachin.

    That is not the vocabulary of a magistrate. It is the vocabulary of someone who treats politics as a street fight. A justice of the Supremo Tribunal Federal does not get to talk like a mobster and then demand that everyone else treat the Court as a temple.

    The remark landed in the middle of a raw institutional fight. Justice André Mendonça had ordered the preventive removal of Federal Police Director-General Andrei Rodrigues and intelligence director Leandro Almada. The Second Chamber was already forming a majority to keep that order in place when Mendes asked for more time, interrupting the session. In his dispatch he questioned the legality of the measure, the chamber’s competence, and the risk that the decision could unbalance the electoral contest. Those are legal arguments. “Kill or die” is not.

    Conservatives have spent years warning that the STF has concentrated too much power, mixed judging with political messaging, and grown accustomed to speaking down to the rest of the republic. This episode fits the pattern. When critics use hard language, they are branded threats to democracy. When a senior justice uses language that would get a congressman denounced as authoritarian, the press treats it as colorful toughness.

    No one is required to accept every rumor about Mendes’ family circle. No one is required to like Mendonça’s order against the PF leadership. What is required is that the Court sound like a court. A judge who frames pressure as a choice between killing and dying is not defending the rule of law. He is advertising that power, not principle, is the real currency.

    Brazil does not need more theater from men in black robes. It needs judges who can answer an allegation without sounding like they are settling a score.

    When an institution is confident, it speaks in procedure. When it is cornered, it speaks in threats.

    “Either you kill or you die” is not the language of a court that believes the law is enough. It is the language of someone who thinks the next move will be dirty, so he might as well announce that he plays dirty too. That is what the Mendes remark showed. Not strength. Panic dressed as toughness.

    A justice who felt secure in the facts would say: publish the documents, test the allegation, recuse if needed, decide the case on the record. A justice who feels the walls closing in reaches for gangster grammar. The message is not legal. It is tribal: we do not negotiate with people who try to constrain us. We finish them.

    Desperation explains the timing. The Court was already split over the Federal Police leadership. Mendes interrupted a session that was moving against the PF directors. Then came the family-link rumor, the Italy photo, the warning to Fachin. Institutions that are winning do not need to broadcast that blackmailers get killed. Institutions that fear a narrative they cannot control do.

    None of this proves every accusation against Mendes’ circle. It does prove something simpler: the highest court in the country no longer sounds like it trusts the law to protect it. It sounds like it trusts fear.

    That is not majesty. That is a tell.
