Brazil’s Highest Court Turns on Itself — and the World Is Watching

    By Hotspotnews

BRASILIA — Brazil’s Supreme Federal Court, long one of Latin America’s most powerful judicial bodies, is in open internal conflict. In the space of 48 hours this week, one justice ordered the suspension of the federal police chief; another justice restored him. The dispute is no longer only about a bank scandal. It is about who controls investigations that now reach sitting members of the Court itself.

On 8 September, Justice André Mendonça, a Jair Bolsonaro appointee and rapporteur of the Banco Master and INSS fraud inquiries, ordered the preventive removal of Federal Police Director-General Andrei Rodrigues and intelligence chief Leandro Almada. Mendonça said the force had produced at least six unsigned intelligence reports that monitored him and Solicitor-General Jorge Messias. Those reports, he wrote, had been forwarded to Justice Alexandre de Moraes and used to support a request that Mendonça himself be investigated. Reuters, Associated Press and Al Jazeera all reported the order and the government’s immediate appeal.

On 9 September, Justice Flávio Dino reversed the order. He directed President Luiz Inácio Lula da Silva to reinstate both officials at once. Dino argued that Partido Novo lacked standing to request the removals, that Mendonça was deciding a matter in which he was personally named, and that only the full Court could settle a clash of this scale. Folha de S.Paulo, O Globo, Estadão and Agência Brasil published the main points of that decision. Dino also noted a 2025 meeting between Mendonça and Daniel Vorcaro, the former Banco Master controller now under investigation. Mendonça’s office has said he received Vorcaro once, at the businessman’s request, and limited himself to listening.

Moraes has not spoken publicly since the police command became the target. His last formal move, on 3 September, was a filing inside the so-called Fake News inquiry asking Chief Justice Edson Fachin to investigate Mendonça for alleged abuse of authority. Fachin removed that request from Moraes’s docket and opened a separate presidential proceeding. BBC Brasil and G1 reconstructed that sequence.

The underlying case is Banco Master, a collapse that Brazilian media and foreign wires describe as involving alleged fraud on a scale large enough to touch politicians across party lines. Mendonça unsealed police material that, authorities say, showed Vorcaro seeking advice from a contact identified as Moraes. That disclosure turned a financial investigation into a credibility crisis for the Court that convicted Bolsonaro of plotting a coup and has spent years policing online speech.

International coverage has been blunt. Reuters called the episode a deepening “court crisis.” AP noted that the justice who imprisoned Bolsonaro is now under fire over alleged links to a disgraced banker. El País, Le Monde and The Washington Post treated the fight as one of the gravest tests of the Court’s legitimacy since redemocratization. U.S. officials, according to Brazilian reporting citing diplomatic sources, are following the case closely.

Chief Justice Fachin canceled a plenary session scheduled for 9 September rather than allow the dispute to explode in open court. He has given the principals deadlines to file written explanations. The Second Chamber had begun to ratify Mendonça’s suspension before Justice Gilmar Mendes requested more time. Dino’s later order is also provisional and must still face the full bench.

What the world sees is not a routine legal disagreement. It sees two justices using single-judge powers to accuse each other of improper motive, a police force yanked in and out of command in a day, and a court president trying to keep the fight off the public stage weeks before Brazil votes. Markets and diplomats do not need to pick a side to register the cost: an institution that claimed to stand above politics is now the subject of the story.

Whether the damage is temporary depends on whether the eleven justices can force this back into one public vote, with a single record, instead of another round of dueling orders. Until then, Brazil’s highest court is litigating its own authority in full view of the world.
