Alexandre de Moraes denies Braga Netto’s attorney, access to evidence on Alleged Coup Attempt legal process.
Supreme Court Minister Alexandre de Moraes, denied a request made by General Walter Braga Netto’s defense, attorney, who requested full access to the evidence against him in the alleged coup attempt. The defense for the former Minister of Defense, who was arrested on December 14, had requested access to the confidential excerpts in the denunciation, by President Jair Bolsonaro’s assistant of orders Lieutenant Colonel Mauro Cid.
Braga Netto’s defense attorney, José Luis Oliveira Lima, justified the request by stating that full access to the elements of the investigation was necessary to ensure the full exercise of the right of defense. However, Minister Alexandre de Moraes argued that the request was unnecessary, since the procedure is being conducted publicly and duly qualified lawyers can obtain copies of the evidence in the Original Criminal Processes at the Supreme Court Judicial Secretariat.
General Braga Netto is investigated for his involvement in the alleged coup attempt, with the Federal Police pointing out that he would have tried to obtain information about Mauro Cid’s denunciation. Braga Netto’s preventive detention was decreed for alleged obstruction of the investigations, at a time when he was one of the key pieces in the planning of the coup.
