BRAZIL: ALL BETS OFF

President Luiz Inácio Lula da Silva’s government is moving toward a total ban on licensed online betting platforms in Brazil, according to reports from SBT News and other outlets following a ministerial meeting on September 23, 2026. The planned Medida Provisória would prohibit both sports betting and online casino games. Officials are also examining court action to make operators cover some gamblers’ debts and have indicated they will not refund the R$30 million licensing fees paid for five-year authorizations. The decision, expected this week, carries wide-ranging social, economic, legal, and political consequences.
Social effects form the core of the government’s stated rationale. Atlas/Bloomberg polling shows 75 percent of Brazilians favor a ban, with many citing family debt and youth exposure. Families lost an estimated R$62.5 billion to betting in 2025, a figure that exceeds the GDP of several states and equals a large share of Bolsa Família spending. Reports from Senate studies and consumer groups describe higher rates of compulsive gambling, mental-health strain, and household insolvency. A ban could reduce legal advertising and easier access for new users, particularly younger ones. At the same time, industry association ANJL warns that demand will not disappear; an estimated 41 percent of betting already occurs on unlicensed sites, and that share could rise sharply if licensed platforms close.
Economic trade-offs are substantial. Receita Federal data show the sector generated nearly R$10 billion in federal taxes in the first eight months of 2026, with full-year collections previously projected between R$12 billion and R$16 billion. Licensed operators paid outorgas totaling more than R$2 billion. Ending the activity would remove that revenue stream and, according to ANJL, could produce compensation claims reaching R$120 billion if courts treat the licenses as binding five-year contracts. The sector claims roughly 15,500 direct and indirect jobs. Football clubs receive about R$1.1 billion annually in betting sponsorships, representing roughly 7 percent of Série A revenues on average and up to 13 percent for some large clubs such as Flamengo. Club officials have warned of reduced investment in squads and youth programs, though government figures note that Brazilian football existed and won titles before the betting boom.
Legal and enforcement questions remain unresolved. Operators that paid the outorga and built Brazilian operations under the 2023–2024 regulatory framework are expected to sue. The government is studying higher penalties for illegal gambling promotion and possible civil actions against companies for problem-gambling debts. Blocking offshore sites has proven difficult; ANJL monitoring identified more than 6,400 active illegal domains in a single recent week. A sudden prohibition could therefore enlarge the unregulated market rather than shrink overall gambling.
Politically, the timing is deliberate. The first round of the 2026 presidential election is approaching, and Lula has framed the issue as protection of families and youth against “algorithms” and “vice turned into profit.” The 75 percent public support offers campaign advantages. Critics, including some industry and sports voices, argue the move risks alienating the more than 30 million registered bettors and their families while inviting congressional resistance from the so-called “bancada das bets.” Football entities have already issued statements calling abrupt change a threat to the sport’s finances.
Possible longer-term outcomes include a smaller legal industry, higher illegal activity, lost tax revenue that must be replaced elsewhere, and continued pressure on household finances if gamblers simply migrate to unregulated platforms. Supporters counter that the social costs already outweigh the fiscal gains and that regulation has not prevented widespread harm. The final text of any Medida Provisória, its congressional fate, and subsequent court rulings will determine which of these consequences materialize.
