    Dino’s Travel Ban and Gag Order: Another Chapter in Brazil’s Two-Tier Justice

    On Thursday, Supreme Court Justice Flávio Dino ordered that federal deputy Mário Frias and 28 other targets of Operation Make Up may not leave Brazil without court permission and may not communicate with one another. Passports are to be surrendered to the Federal Police. The producer company tied to the Bolsonaro biopic Dark Horse was also barred from public tenders.

    The operation, authorized by Dino and executed with the CGU, involved 49 search warrants across São Paulo, Rio de Janeiro, Ceará, and the Federal District. According to the Federal Police, investigators are examining whether parliamentary amendments totaling about R$ 2 million, indicated by Frias in 2024 to the Instituto Conhecer Brasil, were diverted through irregular subcontracting rather than used for the stated social projects. Frias is executive producer and screenwriter of Dark Horse. Businesswoman Karina Gama, linked to the institute and the film’s production company, is also a central target. Police say financial trails show hundreds of millions of reais moving among related firms and list possible crimes including peculato, document fraud, money laundering, and criminal organization. Seven firearms linked to Frias were seized at an address other than his declared residence, prompting a separate illegal-possession inquiry.

    Frias has previously told the Court the amendment money had a social purpose and was not used to finance the film. That denial has not stopped the expansion of the case.

    Conservatives see a familiar pattern. Dino, a former Workers’ Party politician now on the Supreme Court, is using precautionary measures that look more like political containment than narrowly tailored investigation. A travel ban and a prohibition on talking to co-defendants are extraordinary tools. They are being applied here against a Bolsonaro-aligned deputy and people around a film that tells the former president’s story—while a separate STF inquiry under Justice André Mendonça examines other alleged funding streams for the same production. The timing, in an election year, is not lost on anyone.

    Supporters of the operation will say public money must be traced and that judges must prevent collusion. That principle is correct. What is not correct is selective vigor. Brazilians have watched enormous public-contract scandals, NGO networks, and amendment machines operate for years with far less theatrical haste when the political beneficiaries sat on the other side of the aisle. When the target is a right-wing deputy and a Bolsonaro film, dawn raids, gun photos, passport seizures, and a communication ban arrive together.

    None of this proves Frias or the other targets they are guilty. It proves the Court is willing to impose sweeping restrictions before a trial while the public is invited to treat the raid itself as the verdict. That is how institutional trust erodes.

    A serious country investigates embezzlement wherever it appears. It does not turn one film, one deputy, and one justice’s docket into a permanent campaign commercial. If the evidence of diversion is strong, present it in court. If it is not, these precautionary orders will look like what many already believe they are: lawfare dressed as housekeeping.
