    Senate Deadline Tests Whether Congress Will Reclaim Its Own Powers

    Senator Carlos Viana has given Senate President Davi Alcolumbre until noon on 3 September to send forward the latest request to examine Justice Alexandre de Moraes. If nothing happens, Viana says he will move to remove Alcolumbre from the presidency. The demand follows a Federal Police report that included messages and contract details connecting Moraes to Daniel Vorcaro, the former Banco Master banker now at the center of a large fraud investigation.

    The episode is not only about one justice. It is about whether the Senate still treats itself as an independent branch. For years the chamber has accumulated more than a hundred requests against Supreme Court justices and left most of them untouched. Alcolumbre has called that volume “not normal” and has so far declined to give a public judgment on the Vorcaro messages. His allies indicate he would rather wait for the Court itself to act.

    That posture is exactly what Viana and other senators now challenge. They argue the Constitution gives the Senate, not the Court, the power to judge ministers for crimes of responsibility. They say repeated delay looks like deference rather than institutional caution. They also say the public has a right to see the Senate exercise that power instead of handing the “key of the House” to another branch.

    Alcolumbre’s position is not without institutional logic. Opening an impeachment process against a sitting justice is rare, politically costly, and requires votes that have almost never materialized. He was re-elected with a broad coalition. Forcing the issue could split the Senate and invite further conflict with the Court. Those are real calculations.

    The test today is narrower. Will the Senate president at least give a clear institutional answer by the stated hour, or will the request join the pile? A public deadline does not guarantee removal of anyone. It does force a choice: treat the Senate as a co-equal power or treat the pile of requests as a political inconvenience best left untouched.

    Whatever happens after noon, the underlying question remains. A legislature that will not examine serious allegations against members of another branch weakens the separation of powers it is supposed to defend. That is the warning Viana is trying to issue. Whether the Senate hears it is now Alcolumbre’s decision.
