    Eduardo Bolsonaro Tells Moraes “Not Today”: Italian Passport Survives Moraes’ Latest Judicial Strike

    Supreme Court Justice Alexandre de Moraes has once again targeted the Bolsonaro family with an order that cancels Eduardo Bolsonaro’s Brazilian passports, issues an arrest warrant, and begins enforcement of a 4-year, 2-month semi-open prison sentence for “coercion in the course of the process.” Eduardo’s response, captured on video, was characteristically direct: he held up his burgundy Italian passport and effectively told the justice to go to hell.

    Moraes’ decision, signed October 7 and made public the next day, followed the finality of a June 2026 conviction by the STF’s First Panel. The charge stemmed from Eduardo’s advocacy in the United States—lobbying the Trump administration for sanctions and pressure on Brazilian authorities involved in cases against his father, former President Jair Bolsonaro. The panel treated political speech and foreign lobbying as a criminal attempt to obstruct Brazilian proceedings. Political rights were suspended for the duration of the sentence, a fine was imposed, and Brazilian authorities were ordered to cancel every passport the country had issued in Eduardo’s name.

    Eduardo has lived in the United States since early 2025 and holds a green card granted under the Trump administration. He described the latest order as arbitrary, untimely, and ineffective. In the video circulating widely after Moraes’ ruling, he displayed an Italian passport and made clear that Brazilian judicial paperwork does not control documents issued by the Italian Republic. The family’s Italian ancestry—tracing to Anguillara Veneta in the Veneto and maternal lines from Lucca in Tuscany—led Eduardo and his brother Flávio to apply for recognition of citizenship by descent in 2020. Italian authorities confirmed the applications; citizenship by blood is original and not subject to the political preferences of a foreign judge.

    Brazilian courts can void Brazilian travel documents. They cannot reach an Italian passport or dictate the movements of someone with permanent U.S. residence. The order arrives while Flávio Bolsonaro leads polling for the October runoff against President Lula, continuing a pattern in which judicial actions against the family coincide with electoral calendars. Critics of the STF under Moraes have long argued that expansive use of “coercion” and related charges has turned ordinary political advocacy into a criminal offense when directed against the court’s preferred outcomes.     This episode underscores a practical reality for those who view the current Brazilian judiciary as politicized: dual citizenship and foreign residence function as insurance against domestic overreach. Eduardo’s public defiance—holding the Italian document and rejecting the premise that Moraes controls his mobility—illustrates the limits of one nation’s judicial power when another sovereign has already recognized the same person’s nationality by descent. The United States has shown little interest in enforcing Brazilian warrants of this character, further reducing the order’s practical effect.

    For observers concerned about the concentration of power in the STF, the sequence is familiar: a conviction for speech and lobbying, the nullification of domestic travel documents, and an arrest warrant issued against a political opponent living abroad. The Italian passport remains valid. The message from Eduardo Bolsonaro was unambiguous.
