Institutional Crisis at the Heart of Brazil’s Justice System

A grave institutional confrontation is unfolding in Brasília, one that exposes the fragile state of accountability when powerful political interests collide with the rule of law. Supreme Court Justice André Mendonça is investigating whether Federal Police Director-General Andrei Rodrigues obstructed justice in the sprawling INSS fraud investigation known as the “Farra do INSS.” The case involves massive illicit deductions from the pensions of ordinary Brazilian retirees—ordinary citizens who worked a lifetime only to see their benefits siphoned away by organized schemes.
For more than a month, Mendonça, the rapporteur of the investigation, has demanded that the Federal Police deliver all raw documents from the probe and seek his prior authorization before altering the investigating team. The PF has resisted. According to reports, Rodrigues and his leadership maintain that standard procedure requires analysis and reports before materials reach the Court, framing Mendonça’s orders as interference in police autonomy. Mendonça has responded by ordering an inquiry into whether this resistance constitutes procedural disobedience and obstruction of justice. Rodrigues has reportedly told associates that “only the arrest order is missing,” while referring the dispute to the Attorney General’s Office.
This is not a technical disagreement over paperwork. The INSS fraud has already claimed high-level targets and reaches into politically sensitive territory, including inquiries touching figures close to the current administration. When a director-general of the Federal Police—widely regarded as aligned with the government—resists full transparency demanded by a Supreme Court justice, questions of institutional capture inevitably arise. Brazilians have every reason to ask whether the same vigor applied to past investigations of political adversaries is being applied here.
Mendonça’s insistence on direct access to raw materials and control over team changes reflects a legitimate concern for the integrity of the process. In cases involving billions in public funds stolen from the elderly and vulnerable, partial disclosures and unilateral team reshuffles raise legitimate suspicions of selective justice. The PF’s autonomy is important, but autonomy is not a license to withhold evidence from the judicial authority overseeing the case. When resistance escalates to the point that the director-general jokes about pending arrest warrants, the crisis has moved beyond bureaucratic friction into open institutional conflict.
Conservative Brazilians have long warned about the risks of politicizing the security and justice apparatus. The current episode fits a pattern in which institutions appear more protective of certain political orbits than of the public interest. Retirees whose pensions were looted deserve a thorough, unhindered investigation. The country cannot afford a Federal Police leadership that treats legitimate judicial oversight as an attack.
The proper response is straightforward: full compliance with the Court’s orders, complete transparency regarding the evidence, and, if the inquiry confirms obstruction, decisive accountability—including removal from office. Justice André Mendonça is doing his duty by refusing to accept half-measures. The Federal Police must do the same. Anything less undermines the very institutions Brazilians rely on to protect the rule of law against both ordinary criminals and the powerful.
