    Nikolas Ferreira Moves Against Moraes: Investigation, Removal and Arrest Requests Face High Institutional Barriers

    Federal deputy Nikolas Ferreira (PL-MG) announced on September 1, 2026 that he will petition the Supreme Federal Court for three measures against Justice Alexandre de Moraes: the immediate opening of a criminal investigation, precautionary removal from office, and preventive detention. The requests follow the unsealing of a Federal Police report in the Banco Master case that documents contacts between Moraes and banker Daniel Vorcaro.

    The PF material, whose secrecy was lifted by Justice André Mendonça, the rapporteur of the Master inquiry, lists messages extracted from Vorcaro’s phone. In them the banker refers to in-person meetings with Moraes, expresses “eternal gratitude,” asks whether he should leave the country days before his November 2025 arrest, and seeks help to “block” investigative steps involving the Federal Police director and the Prosecutor-General. The same report notes that a contract of roughly R$131 million between Banco Master and the law firm of Moraes’s wife, Viviane Barci de Moraes, was edited on a profile identified as belonging to the minister.

    Ferreira compared the situation to the preventive arrest of former Bolsonaro aide Filipe Martins, arguing that the same flight-risk standard should apply. He publicly urged Mendonça to “make history.” Other opposition figures, including presidential pre-candidate Flávio Bolsonaro, called for Moraes to resign if the allegations are confirmed and floated new impeachment talk in the Senate.

    Brazilian constitutional rules place any criminal inquiry into a sitting STF justice under the exclusive competence of the Court’s own plenary. The Prosecutor-General’s Office must first evaluate the evidence and decide whether to request an inquiry; that request then needs plenary authorization. Mendonça has already sent the PF report to the PGR and asked Court President Edson Fachin to schedule a public, in-person plenary session. The PGR has raised procedural objections, including claims of nullity.

    Historically the STF has rejected the overwhelming majority of recusal and removal petitions against its members at the earliest stage; hundreds of such requests since 2016 never reached the full bench. Preventive detention of a justice would be unprecedented and requires a showing of concrete flight risk plus other statutory grounds that the currently public documents—one-sided messages and contract metadata—have not yet formally established as an accusation.

    The most probable short-term outcome is therefore a public debate over whether an inquiry should even be opened rather than the removal or arrest Ferreira seeks. Political pressure generated by the unsealed files and the opposition’s campaign may force Moraes to offer a detailed public explanation and keep the issue on the national agenda. Success on the three specific requests themselves remains low because of the Court’s institutional self-protection, the PGR’s stance, and the high legal threshold for measures against a sitting minister.
