The End of the 6×1 Schedule: Approval Without Answers

The Brazilian Senate approved the constitutional amendment ending the 6×1 work schedule on October 14, 2026. The vote was 75 to 1. The text reduces the maximum weekly working time from 44 hours to 40 hours in two stages over 14 months, guarantees two paid rest days per week, and forbids any reduction in salary. The only senator who voted against it was Hamilton Mourão. Flávio Bolsonaro, who had previously called the proposal opportunistic and preferred a more flexible model based on negotiation or payment by hours worked, voted in favor. He said the majority of workers wanted the change.

The measure matches a clear preference among many employees for shorter hours and more rest. Whether it produces lasting improvements in employment, productivity, or living standards is a separate question that the vote itself does not resolve.

The main open issues are economic. In sectors that have long used 6×1 shifts—retail, services, and security—cutting hours while protecting pay raises the cost of each hour worked. Companies can respond by raising prices, reducing staff, shifting work to informal arrangements, or trying to extract higher output from the remaining hours. The 14-month phase-in (first to 42 hours, then to 40) delays the full effect but does not eliminate it. The approved text contains no accompanying measures on productivity, compensation for employers, or greater schedule flexibility. Several senators noted that the amendment does not clearly address home-office workers, part-time arrangements, or parents who can only work limited hours because of childcare.

Flávio Bolsonaro and others who ultimately voted yes have said they still prefer systems in which employer and employee can negotiate schedules more freely. The amendment that passed is more rigid. How it will operate for small businesses, seasonal work, or workers with irregular hours remains unspecified.

Supporters point to reduced exhaustion and more family time. Critics point to higher unit labor costs and the risk that some jobs move outside formal contracts. Both effects can occur at the same time. The first stage of the reduction is expected to take effect roughly two months after promulgation. Only after that stage, and the later move to 40 hours, will measurable data on employment, formality, prices, and output become available. Until then, the large majority in the Senate shows political and popular support; it does not demonstrate the long-term labor-market result.

Sources: Reporting from G1, BBC News Brasil, CNN Brasil, Valor Econômico, and Estadão (13–15 October 2026) on the final vote count, Flávio Bolsonaro’s statements before and after the vote, and the content of the approved text.
