    Brazil: Supreme Court will have Fachin as new president in September

    Supreme will have Fachin as new president in September

    There is still no date for the inauguration ceremony, which must be held before the conclusion of Roberto Barroso’s mandate; Moraes will be the deputy

    The STF (Supreme Federal Court) will have a new president from September 2025. With the end of the mandate of the current president, Minister Roberto Barroso, it will be up to Edson Fachin to head the Court.

    Fachin is the current vice president, next to Barroso. Both took office on September 28, 2023 to exercise 2 years of mandate. The period, therefore, ends on September 28, 2025, the month in which the new president and vice president should be sworn in.

    Who will assume the vice-presidency will be Minister Alexandre de Moraes. He will remain in office until 2027. After that, by succession order, he must assume command of the court in the following 2 years, until 2029.

    The choice for the presidency is made through voting among the ministers. However, by tradition, the collegiate elects as president the oldest minister who has not yet held office and, as vice, the one who must assume the presidency in the next term.

    It is up to the president of the Supreme Court, for example, to decide the composition of the plenary agenda, with the cases to be judged by the ministers. He also assumes administrative tasks of the Court and holds the presidency of the CNJ (National Council of Justice), the supervisory body of the Judiciary.

    The position also puts the minister in a position of political prominence, since he is the one who represents the court before the other Powers and authorities.

    WHO IS EDSON FACHIN?

    With a more discreet profile, Fachin is 66 years old and is a native of Rondinha (RS). He took office as minister of the Supreme Court on June 16, 2015, after being appointed by the then President of the Republic, Dilma Rousseff (PT), for the position of retired minister Joaquim Barbosa.

    He has a law degree from UFPR (Federal University of Paraná), where he also taught, and has a doctorate in social relations law from PUC-SP (Pontifical Catholic University of São Paulo). Before becoming a minister, Fachin was also a prosecutor of the State of Paraná.

    In the Supreme Court, Fachin is the rapporteur of at least 2 processes that may reverberate throughout 2025. One of them concerns “uberization”, which discusses the existence of an employment relationship between drivers and digital platforms. The topic was the subject of a public hearing at the end of 2024 and can be taken to the plenary in 2025.

    The other is the so-called “ADPF das Favelas”, which deals with police violence in Rio de Janeiro. The action gained projection for requesting that police officers use cameras in their uniforms and was the target of criticism by members of the state government for “hindering” the work of police officers in Rio’s favelas.

    By assuming the presidency, Fachin will be able to give up the processes to take care of institutional tasks. However, it will be your responsibility to guide the actions that will be discussed in the plenary of the Court.

    WHO IS ALEXANDRE DE MORAES?

    Alexandre de Moraes, 56, was born in São Paulo (SP) and arrived at the Supreme Court in 2017 by indication of former President Michel Temer (MDB). He replaced Teori Zavascki, who died in a plane crash in January of that year.

    During the Temer government, Moraes was Minister of Justice. Before, he was also state secretary of Public Security of São Paulo from 2015 to 2016, when Geraldo Alckmin (PSB) was governor of the state.

    Moraes has a degree in law from USP (University of São Paulo), a college where he also obtained a doctorate in state law.

    Under the minister’s authority, some of the main investigations involving former President Jair Bolsonaro (PL) and his surroundings are concentrated, such as the investigation of digital militias, fake news and the alleged coup plot, whose developments should continue throughout 2025.

    Another action that can be completed in 2025 and is under Moraes’ report concerns the Marielle case. Five involved in the case – among them the Brazão brothers – are defendants in the Supreme Court. The expectation is that your trial will be held in 2025.
