    Flávio Bolsonaro Files Complaint Accusing Federal Police Chief of Using Agency to Influence Voters on Election Day

    On October 11, 2026, Flávio Bolsonaro, the PL presidential candidate and son of former President Jair Bolsonaro, submitted a notícia-crime to Brazil’s electoral justice system against Andrei Rodrigues, the director-general of the Federal Police (PF). The filing alleges that Rodrigues engaged in electoral misconduct by publicly announcing a preliminary investigation into supposed U.S. interference favoring Brazil’s right-wing forces on the very day of the first-round vote.

    The announcement occurred during a press conference Rodrigues held on October 4 in Brasília, while voters were casting ballots. He stated that the PF had received a representation from the Advocacia-Geral da União (AGU) and was conducting a preliminary inquiry into possible foreign funding of groups critical of the Supreme Federal Court, drawing from a report in the British newspaper The Guardian. At the time, no formal police inquiry had been opened. Three days later, on October 7, the PF archived the matter for lack of sufficient evidence or just cause.

    Bolsonaro’s legal team argues that the timing of the announcement—delivered in an official capacity on election day and later shown to rest on thin grounds—was capable of shaping public perception against the conservative candidate and the broader right-wing electorate. The complaint cites provisions of Brazil’s Electoral Code that prohibit the use of public agencies or resources to benefit a political party or candidate. It contends that highlighting an unproven narrative of external support for the right, precisely while voting was underway, served the interests of President Lula’s PT campaign.

    Critics from the conservative side see the episode as another instance of law-enforcement institutions being drawn into the political arena during a high-stakes election cycle. Rodrigues, appointed under the current administration, has faced prior scrutiny in connection with high-profile investigations touching figures associated with the previous government. The rapid archiving of the probe after the voting day statement has fueled questions about whether the public disclosure served more as a political signal than as a genuine investigative step.

    Supporters of institutional neutrality argue that the head of the Federal Police should avoid public comments on politically sensitive matters on election day, especially when the underlying representation originates from a government legal office and lacks corroborating evidence. The complaint asks electoral authorities to examine whether Rodrigues’s actions crossed into improper use of the federal police structure for partisan advantage.

    As the 2026 presidential race continues, the case underscores ongoing debates in Brazil over the independence of public institutions and the boundaries of official statements during electoral periods. Flávio Bolsonaro’s filing places the burden on electoral justice to determine whether the sequence of events warrants further scrutiny.
