Foreign Judge Tries to Censor Americans — And Brazil Says U.S. Courts Can’t Stop Him

A Brazilian Supreme Court justice has been ordering American companies to silence people. Now his government is telling a Florida court: “You have no right to even look at this.”
That is the heart of the fight between Rumble, Trump Media, and Justice Alexandre de Moraes.
What happened
Rumble is an American video platform. Trump Media runs Truth Social. Both are based in the United States and built on free-speech principles.
Justice Moraes, a powerful Brazilian judge, has issued secret orders telling these companies to take down accounts and content — including posts by people living in America. He has threatened heavy daily fines and even tried to shut Rumble down in Brazil when they refused.
Rumble and Trump Media said “no.” They sued Moraes in federal court in Florida. Their simple claim: A foreign judge cannot reach into the United States and force American companies to censor speech protected by the First Amendment.
Brazil’s response
Instead of defending the orders on the merits, Brazil’s government jumped into the case. They argue:
- Moraes was just doing his official job.
- Therefore the lawsuit is really against Brazil itself.
- Foreign countries have “sovereign immunity,” so U.S. courts cannot touch the case.
- American judges should stay out of it.
In plain English: Brazil wants the power to censor content on U.S. soil — but claims American courts have no power to stop it.
Why this is a big problem
This is not about Brazilian politics. It is about American sovereignty and free speech.
If a foreign judge can email secret orders to Florida companies demanding they delete legal American content, and then hide behind immunity when challenged, every U.S. platform is at risk. Today it is Rumble and Truth Social. Tomorrow it could be any website that allows open discussion.
The First Amendment was written to stop government censorship. It was not written so foreign governments could do the censoring instead.
Where things stand
In early August 2026, the Florida judge allowed Brazil to file one more short brief defending its immunity claim. The court has not yet decided whether to throw the case out.
Rumble and Trump Media are still fighting. They argue that no foreign official should be able to regulate speech inside the United States without facing American courts.
Bottom line
Free speech is not a privilege that foreign judges get to cancel. When an American company hosts content on American servers, U.S. law — not Brazilian orders — should control.
Brazil’s “you can’t touch us” argument is an attempt to export censorship while blocking any real accountability. That is not how free countries work.
Americans should pay attention. If this kind of overreach succeeds, the internet gets smaller and quieter for everyone.
