By ordering the Federal Police to immediately transmit every deposition, expert report, and investigative act in the Operação Sem Desconto probe to the STF—and to provide advance notice of any personnel changes—Mendonça has taken a measured but firm step to protect the integrity of one of Brazil’s most consequential corruption investigations.
The case involves a massive scheme of irregular deductions from the pensions and retirement benefits of ordinary Brazilians. Hundreds of thousands of retirees and pensioners were systematically drained of hard-earned income through fraudulent “associative” discounts. The scale is enormous, the victims are among the most vulnerable, and the public interest in a thorough, independent inquiry could not be higher.
Yet in May the Federal Police quietly shifted the investigation’s coordination, removing the lead delegate who had pursued sensitive lines of inquiry and relocating the team without prior notice to the rapporteur. Additional changes involving another delegate, a forensic expert, and the physical workspace followed. Mendonça learned of these moves largely through defense attorneys rather than official channels. That lack of transparency is not a minor bureaucratic slip. When an investigation sits before the nation’s highest court and touches politically sensitive figures, opacity invites suspicion.
Mendonça’s recent order restores proper judicial oversight. As rapporteur, he is responsible for ensuring the inquiry proceeds without selective delays, unexplained personnel rotations, or the appearance of external influence. Requiring the full record to be filed promptly in the Supreme Court process and demanding advance notice of team alterations is not micromanagement; it is basic accountability. In high-stakes cases involving public funds and potential connections to powerful interests, the judiciary has both the authority and the duty to insist on visibility.
Critics within the Federal Police and the Public Prosecutor’s Office have grumbled that the measures signal distrust. They miss the point. Trust is earned through consistent transparency, not demanded as an entitlement. When an investigative body alters leadership on a politically charged probe without informing the judge who supervises it, the judge is entitled—indeed obligated—to tighten the reins. The alternative is to accept a process in which critical decisions about staffing and direction can occur in the shadows.
This episode also underscores a broader institutional reality. Large-scale fraud against social security is not a technical problem; it is a moral and political one. The victims are retirees who counted on their benefits. Any investigation that risks being slowed, redirected, or diluted by internal rearrangements fails those citizens. Mendonça’s insistence on full disclosure and prior notification places the focus where it belongs: on the evidence, the victims, and the uninterrupted pursuit of accountability.
Judicial independence is not a slogan. It is the practical requirement that judges retain meaningful control over cases that reach the Supreme Court. By acting decisively, Mendonça has reminded the system that no investigative body operates beyond the reach of the Constitution or the scrutiny of the court. In a time when public confidence in institutions is fragile, that reminder is both timely and necessary.
