The petition goes further, cataloguing what it describes as a cascade of irregularities: the wholesale cancellation of Eduardo Bolsonaro’s Brazilian passports without a single line of legal foundation or any concrete finding of flight risk; glaring geographic contradictions in which the court treated the defendant as residing at an uncertain address for service of process yet acted with surgical precision to strip his documents abroad; and material errors ranging from mismatched fine calculations to the citation of the wrong public body. To keep the habeas corpus out of the hands of the very minister who signed the contested orders, the lawyers invoked STF Resolution 921 and demanded free distribution to the full Plenary, excluding Moraes as the alleged coercing authority.
The underlying conviction itself stems from the First Panel’s finding that Eduardo, while in the United States, sought to pressure Brazilian authorities through foreign sanctions in connection with the proceedings against his father.
