Trump Rumble lawsuit has a decision for the injunction filed yesterday

There  has been a decision in the lawsuit filed by Trump Media & Technology Group and Rumble against Alexandre de Moraes in the U.S. federal court in Tampa, Florida. On February 25, 2025, U.S. District Judge Virginia Hernandez Covington denied their request for a preliminary injunction. This lawsuit, initiated on February 19, 2025, sought to block Moraes’s orders to suspend Rumble accounts linked to Allan dos Santos, a Brazilian right-wing commentator living in the U.S., arguing these directives violated U.S. free speech laws and sovereignty.

The judge’s ruling clarified that Moraes’s orders applied only within Brazil’s jurisdiction, not the U.S., and thus did not infringe on American sovereignty or First Amendment rights. She noted that Rumble faced no penalties in the U.S. for noncompliance and that the companies failed to demonstrate imminent harm or a likelihood of success on the merits—key requirements for an injunction. The decision emphasized that Brazil’s legal framework, unlike the U.S., allows for such restrictions, and Moraes’s actions were aimed at regulating content accessible in Brazil, not extraterritorially in the U.S.

This ruling came shortly after Moraes ordered Rumble’s suspension in Brazil on February 21, 2025, for noncompliance with prior court mandates, including appointing a legal representative. While Rumble and Trump Media claimed a “total win” in a statement, suggesting the decision limited Moraes’s reach, the denial of the injunction was widely seen as a setback for their immediate goals. The case itself remains ongoing, but no further decision beyond the injunction denial has been reported as of today, February 26, 2025.
