US House Committee publishes confidential decisions of Moraes
Dozens of judicial determinations taken in the investigation of digital militias were published. Most refer to Moraes’ orders to suspend extremist profiles
The Judicial Committee of the United States House of Representatives released dozens of decisions by Minister Alexandre de Moraes, of the Supreme Court (STF). The court orders were sent to companies that manage digital platforms, such as X (formerly Twitter) and Meta, owner of Facebook and WhatsApp.
In all, 28 judicial decisions in English, 23 orders in Portuguese and 37 determinations of the Superior Electoral Court (TSE) were published on the committee’s website. The documents are part of the investigation of digital militias and are orders for the suspension of extremist profiles on platforms. Those investigated are accused of attacking institutions, making threats against authorities, spreading false information about the electoral system and inciting a coup d’état.
One of the profiles urges the military to “invade Brasilia, go to the front of the barracks and force the TSE to provide the source code of the electronic voting machines”. The same profile apologized to the military regime, saying that it arrested “guerrillas” and that “good people” were not arrested.
In one of the decisions, Minister Alexandre de Moraes states that deputies such as Bia Kicis and Gustavo Gayer disclosed false information, from an unofficial entity called “Conservative Bar Association” as if it were the Brazilian Bar Association.
Moraes mentions that Bia Kicis used the Chamber’s tribune to spread the false information that an elderly woman, allegedly arrested for the January 8 attacks, had died while she was detained in the Federal Police. The parliamentarian, according to the document, would have cited the false entity to substantiate the fake news. In the same decision, Moraes describes a response from Bia to Deputy André Janones, where she states that when she came down from the tribune she was informed that the information was false and corrected it.
In the decision, Moraes determines the suspension of the profile of the entity that would be posing as the OAB; The report of the U.S. House committee accuses Moraes of censorship and the government of Joe Biden, president of the United States, of omitting the case. The document was produced at the behest of a right-wing congressman of the Republican Party, who is in opposition to the Biden government.
The collegiate has no power of Justice in the United States, nor to decide for Congress or the US government, but it can make recommendations to organs of the country and take the issue for analysis of the plenary of the legislative house.
