    Leaked Messages Expose a Court at War With Itself

    Reported WhatsApp exchanges among Brazil’s Supreme Court ministers have pulled the curtain back on something the public already suspected: the country’s highest court is not operating as a calm, collegial tribunal. It is operating as a political battlefield.

    According to accounts published this week, Minister Gilmar Mendes pressed colleagues Luiz Fux and Kassio Nunes Marques after a Second Panel vote on the removal of Federal Police Director-General Andrei Rodrigues. Mendes accused them of acting in lockstep with Minister André Mendonça, demanded they “open their accounts,” told them to leave the cases, and told Nunes Marques to leave the presidency of the Superior Electoral Court as well. Nunes Marques answered that the tone was not appropriate, said he had accounted for his finances for 15 years as a judge, and then blocked Mendes. Fux told Mendes, in substance, to stop lecturing him and not to bother him.

    That is not ordinary judicial disagreement. It is a dean of the Court using private messages to demand recusal, financial disclosure, and institutional retreat from fellow justices. The trigger is not abstract doctrine. It is the Banco Master / Daniel Vorcaro investigation, including reported references to family members of ministers and a separate fight over whether the Court will investigate Minister Alexandre de Moraes.

    A court that lectures the country about institutions cannot treat WhatsApp as a back channel for pressure. If there is a genuine conflict of interest, the remedy is a formal motion, a public recusal, and a recorded vote—not late-night messages telling colleagues they are “screwed” and should get out of the way. If there is no conflict, the demand itself becomes an attempt to shape a case by intimidation.

    The episode also shows why trust in the STF has collapsed for a large part of the country. The same Court that has expanded its political reach now appears split by personal alliances, family suspicions, and raw language. Blocking a colleague on WhatsApp is not a legal argument. Telling another justice not to “fill my bag” is not a reasoned opinion. Those are signs of a body that has lost the distance required of a final court.

    Brazil does not need more theater from the Palace of Justice. It needs judges who recuse when they must, vote on the record when they can, and keep private pressure out of public power. Until that standard returns, every high-profile case will look less like law and more like factional combat.
