The Censor Faces Judgment — and the Court Hits Pause

Alexandre de Moraes spent years presenting himself as the indispensable guardian of Brazilian democracy. From the Supreme Federal Court he led the investigations that sent former President Jair Bolsonaro to prison, imposed sweeping speech restrictions, and ordered the nationwide blocking of X. Now the same justice sits at the center of the country’s largest banking-fraud scandal in a generation. On Tuesday, September 15, the court convened an unprecedented plenary to decide whether one of its own members should face a formal investigation. It adjourned without an answer.
The collapse of Banco Master has produced documents, metadata, and text messages that raise serious questions about whether Moraes maintained an unusually close relationship with the bank’s owner while his wife’s law firm collected tens of millions of reais. The court did not resolve those questions. It spent the session on a preliminary fight over procedure, then Justice Flávio Dino requested more time to study the file, suspending the matter for up to 90 days — potentially until mid-December, after the October elections.
What the record shows
Banco Master was liquidated by Brazil’s Central Bank in November 2025 after regulators uncovered what investigators describe as a Ponzi-style scheme built on fraudulent financial products. Owner Daniel Vorcaro was arrested while attempting to leave the country and was jailed again in March. The hole left behind is estimated in the tens of billions of reais and has drawn in politicians, central-bank officials, and members of the judiciary.
Federal Police recovered Vorcaro’s phone and documented more than 50 messages sent to a number associated with Moraes between late 2023 and November 2025, plus multiple in-person meetings. Investigators have identified eight confirmed encounters in 2024 and 2025. In one exchange days before his arrest, Vorcaro asked whether he needed to leave the country.
Separately, metadata on a legal-services contract between Banco Master and Barci de Moraes Advogados — the firm run by the justice’s wife, Viviane Barci de Moraes — shows the document was last edited under a profile registered to “Ministro Alexandre de Moraes.” The contract was valued at approximately R$131 million, with monthly installments in the millions of reais. Tax records indicate about R$80 million was paid over 22 months before the bank collapsed.
Moraes has denied any improper conduct. He says he never judged cases involving the bank or Vorcaro, that conversations concerned other matters such as international sanctions, and that the police report unsealed against him was unconstitutional and politically motivated. He has accused fellow Justice André Mendonça, a Bolsonaro appointee who released the report, of abusing his authority and of revenge for the coup convictions. Mendonça denies the charge. Chief Justice Edson Fachin has tried to contain the damage by unsealing thousands of pages and taking over as rapporteur. President Luiz Inácio Lula da Silva publicly called for full disclosure.
Tuesday’s session: procedure over substance
The plenary never reached the core question — whether Moraes should be investigated. It deadlocked on whether his file should be joined with accusations of procedural irregularities against Mendonça. A partial tally stood at 4–3 to keep the cases separate: Fachin, Mendonça, Luiz Fux, and Cármen Lúcia versus Gilmar Mendes, Cristiano Zanin, and Moraes. Dino, who had leaned toward joining them, converted his position into a request for more time after a heated exchange. The session grew acrimonious enough that Cármen Lúcia apologized to the public; Dino called the proceeding disastrous. Two justices had already recused: Dias Toffoli and Kassio Nunes Marques.
A hearing on Mendonça’s conduct that had been set for September 23 is now in doubt. Vorcaro is scheduled to give sworn testimony to federal police on September 24.
Election timing
Brazil votes on October 4, with a possible runoff on October 25. The race between Lula and Senator Flávio Bolsonaro is tight. Opposition figures have tied Lula to Moraes; the Banco Master leaks have also embarrassed power brokers on the right, including Flávio Bolsonaro, who has denied wrongdoing and described some dealings with Vorcaro as private. The court’s delay keeps the institutional fight alive through the campaign without forcing a vote that would immediately damage one faction or the other.
The conservative critique remains straightforward. An unelected justice accumulated extraordinary power — ordering content takedowns, investigating sitting lawmakers, and shaping the electoral environment — while family financial interests intersected with a failed bank that cultivated influence across Brasília. The same standard Moraes applied to others is now being applied, however imperfectly, to him.
The Banco Master affair is not a partisan morality play. Figures on both sides of the aisle received payments or favors from Vorcaro. That fact does not erase the appearance of conflict at the highest level of the judiciary. When a justice who spent years lecturing the country about the rule of law finds his own family’s contract and personal communications under scrutiny, the public is entitled to answers rather than institutional self-protection. Whether the court eventually opens an inquiry, buries the matter after the election, or splits the difference will tell Brazilians more about the health of their institutions than any campaign speech.
